Procedural Question. Attorney files a suit against me and with the response I DV him and motion for a dismissal. My question is can he procede with any thing before he answers the DV. Or can he answer the motion to dismiss without the Validation first.?
Was this the first contact you received from the debt collector? You need to make sure you send that DV within the 30-day timeframe. My understanding is that if the demand for validation is timely, then they should have to respond before they move forward.
