Actually, I've tweaked it a bit more (and the new version will be up on CreditCourt later today).

I'm taking the part about the $2,500 out. Since this is a Motion to Deny - it's probably not the proper place for it.

My relief that I am asking for is for the Judge to Deny the Defendant's Motions. Once I survive that obstacle - then I'll put in a Motion to Ammend and raise the amount.

However, I think I'll proably still keep the part about attorneys fees (on my side) as you worded it - if I decide to retain counsel.

Thanks - I slept fairly well. Right now I'm in the process of really tweaking my motion. I'm double-checking EVERYTHING (I want to win this!).

I've got to tell you Sassy - you pulled out a good one! I RE-checked the AZ code they used for jurisdiction - and they really, truly DID use one that is for VEHICLE law!

I think I might put that in BOLD!

I've checked and re-checked and checked again as well. I can't believe an attorney would be so dumb, really!

I hope the days go by fast for you from now to the 11th, LOL, how will you be notified of the decision, by mail?

Yes, unless I actually go to the courthouse - I'll be notified by mail. I'd like to go - but it doesn't look like they encourage that - as it's not really a "hearing". I generally work on Fridays (which is what that day is). So, I guess I wait for the mail.....

I probably also can call the court on Monday and find out.

I'm with you, it's not a hearing hearing, LOL.

The judge will read the motions and responses and decide; type it up and send it to you.

Tap, tap, tap -- waiting on the postal service, as usual ;-)

I do hope you will post his decision, I can't wait to find out!
