1 year old bad check

    I had a check bounce for 181.00 a year ago april, the original collector was unable to collect as I said I would only work with the OC, they dropped it, never showed on my Credit report. Now the OC has hired a new company to do bad check collections and this new company called me and wanted payment. I verbally asked for verification and asked if they bought the debt. When they said they did not buy, just are collecting for the OC, I asked what legal right to the debt they had? she said "I can' t give you legal advise". WTF?

    Anywho, this new company did not send a 30-day letter to me indicating that they were collecting the debt, just a phone call, is there something wrong with this?

    i usually side with paying the debt. As the original person you wrote the check for can throw ur butt in jail for a bad check. Seen it done to a friend, by publix no less.

    Check your state laws on SOL, and felony/misdermeanor bad check laws.

    I agree with Sam. For $180, just pay the OC and get a receipt and tell the CA to pound sand.

    Yep, pay the folks you wrote the check to. In most states this is at least a misdemeanor. It's definitely not the same as not paying a credit card balance.

    In VA it is called "uttering" - under $200 is a misdemeanor, over $200 is a felony. Do it too many times and you get a prison sentence and a criminal record in my state.

    actually a criminal record begins when you are arrested.

    If you are arrested, regardless of guilt, companies that check ur background will usually not hire you.

    Sue the CA for violations.
    If I have to obey the law regarding the check then I expect the CA to obey the laws covering them.
