Account Itemizations after Collections Agency takes over-Help!

    Hi again everyone,

    I thought I'd post my second question. A few years ago, I was renting from an Apartment complex. I paid every bill on time. The way the apt. complex worked, after your original lease term, they would either invite you to renew again, or tell you to leave.

    I received two separate notices. The first told me they would like to have me. The second (after having an ex stalk me and showing the PPO paperwork to the complex manager), they sent me a letter telling me to be out by April 30. I left, and paid through April accordingly.

    I moved, and never received any notice of any kind from the apt. Fast forward to now--I have a ding on my credit report from a collections agency for 2700, (Anthem collections agency).

    I went to apartment complex, recorded my conversation with the mngr. per our state standards, and asked for an itemized list of any bills, as well as any and all documentation they have on file. She told me she could not provide that, and to go through the collections agency.

    I contacted the collections agency, and they told me it was showing on their end that I owed for two months of unpaid rent, for the months of may and june.

    Legally, I want my file! This manager is notorious for being corrupt. My fear is she will go into the actual file and destroy all paperwork. Also, seeing his was years ago (and left when I was supposed to, and always paid on time), I never kept the paperwork telling me to stay...and then leave by the 30th.

    I would REALLY appreciate your help!!!!

    For now I would dispute this with the credit bureaus to get it off your report, then worry about making it right with collection agency later. I have had several negative items removed from my report and then ignored the collection agency until my statue of limitations is up (7 years from the date of delinquency) and have had good luck. I think they can still try to come after you, but they can't report to the bureaus after the 7 years. Hopefully you have good luck removing it from your report so it's not damaging your profile and score.

    Sorry to hear this happened to you greeneyez. These tenant/landlord issues are often tough to resolve, even though it sounds like they were really the ones at fault due to giving you the wrong information and then never providing any follow up communication after you moved out.

    Does this report as a charge-off on your credit reports? I'm just curious if they sold the account to the collection agency or if they just transferred it to them for collection.

    I would definitely try disputing the debt in its entirety through the CRAs. Dispute in writing, explain why the debt is not valid, send CMRRR, and hope for the best.

    Then we can help you develop a strategy for dealing with the CA if they keep hounding you.

    Thank you for the input. Yes, the debt is now listed through Allstate collection agency. The apt. manager won't give me my account info, saying that I have to go directly through Allstate. Allstate is saying they only have what the apt. complex sent them (which is wrong). I'm stuck.

    You want to demand the VALIDATION through the CA. It's the only way that your rights under the FDCPA are protected.

    You want to dispute the account in it's entirety and demand complete and total validation of the account, including all records and correspondence with you.

    Jam's right. Since the account is with the CA now, you need to demand validation with them first to protect your rights.
