EQ sends someone to the courthouse to verify a judgment. To verify the judgment as yours EQ looks for your name, SS#, and address. They need to match two of those three pieces of information from the court file with the information in your credit file to verify the judgment as yours. Many case files do not contain any documents with your SS# even if the creditor had it. Look at the court file. EQ may be using your name and an old address to verify. Good luck Ender.
What if they have the address and name correct? Is there anything I can do? This is also a paid, satisfied judgement. The CA agreed they will not dispute if I try and vacate it. How would I go about doing this?
i just got paid judgement removed from dh's tu and eq using simple dispute not mine. i guess i got lucky it came off first round. they do not always send someone to courthouse. they also send verification form to court and ask information or verify via database.. call the court clerk and ask them how they verify. also, seeing how hard it is for you to get copy of case file can let you know how hard it would be for cra to verify.
how long ago was the judgement..?? chances are if you wait a few months.. then go down to the courthouse to see if they can find the judgement.. if they cant it might be because it was filed away in storage.. then redispute... Kev
According to EQ their policy is to physically send someone to the courthouse and verify by name, SS# and address. Would they lie? LOL It is easy to pull a file. The clerk will help you. I have a judgment unpaid that was reported on EQ It is a long story but I refuse to pay it. I was sued because of money I witheld from a contract payment after the individual I had the contract with stole from me. I knew that if I witheld the payment he could sue and win but I didn't think he would have the b****. In court of course his theft wasn't a good defense but I refused to pay on principal and a judgment was ordered. He doesn't have the b**** to attempt collection on the judgment. Anyway.... My SS# was not in the court file and the address on the docs. was an old address. I disputed the judgment and it came back verified. I had the old address removed as 'incorrect' from my file and disputed the judgment again as 'not mine'. Did it by phone to avoid putting 'not mine' in writing. It was deleted. Morally right? No. I however didn't feel the need to suffer with this record and felt no obligation to tell EQ that the address was only incorrect due to their spelling error. I felt OK holding them to their own standard of 'complete and accurate' in this instance. I got my deletion and will live with the guilt. File a motion to vacate Ender. Do you have a technical reason as to why the judgment could be challenged? Not properly served, etc. If you do, your motion will likely be granted if the defendants are a no show. Do at least offer the court some technical reason as to why the judgment should be set aside however in your motion. Good luck to you.
