    Hello,
My mother in law fell behind on her GE Capital card recently. The account was sent to Arrow on 1/27/03. Her total owed is $3300. Arrow called her last Thursday and demanded $2600 to settle by 2/28 or their sueing her. They also stated they needed a post dated check over the phone by Monday 2/10 and they'll hold it until 2/28. I called them back for
her and of course the person I spoke with was an as%hole. Same story post dated check by Monday or their filing a law suit. I told him to save his BS and we'll decide what we want to do? What should I do? Please help!

Don't go for any online checks or post dated ones either. That leads to grief far too many times to take a chance with them.

Have you demanded they validate the debt? I'd do that but doing so won't stop their collection efforts or filing a lawsuit. Best stop talking to them on the phone and make them put it in writing. They best not be threatening you with a lawsuit in writing.

I tend to think they are just trying to do a classic bulldozer job on you but it is always possible that they will sue you.

What???? I'm sorry, but that is just wrong advice.

You are within the first 30 days, so sending out dispute/validation will definitely stop further collection efforts.

If they don't stop, they are violating the FDCPA, and YOU have grounds for a lawsuit. They can file a lawsuit on 2/28, IF YOU DON'T DISPUTE.

Fax over a validation letter immediately, and follow up with certified mail return receipt.

Also, how far behind is she on the card? Has it gone to charge-off? Has she talked to GE about trying to work it out?

Get Arrow of your back immediately, and if it hasn't gone to CO, she might be able to work something out with the OC.

When the threaten lawsuit you can threaten BK.

Never give them the checking account #. Lots of times they will go in and take the money. Even if they do it illegally you have the hassle of suing and collecting from them.

listen to jlynn and send off that validation letter!! They are jerks and strong-arming is their specialty. Have you received anything IN WRITING from the CA?
