Received a debt collection letter in the mail today for almost 3K. I have been in line with my credit reports for almost 3 years now and NEVER saw anything about the acct that they refer to. How should I go about inquiring what this is all about without getting hoodwinked? I have 30 days to respond to this letter or they will say it is legit. Any info would be greatly appreciated!
It doesn't have to be a complex letter, it just has to say one or two things, I have no idea what you are talking about, and I want you to prove your claims.
http://consumers.creditnet.com/Disc...etter-63655.html?highlight=what+is+validation A thread which explains the origins of this really simple validation letter (although the one that I came up with off the top of my head is phrased differently), the main parts are based off of this case-law. My personal letters are a little more complex, just because I tend to notice violations and go for the jugular on the first letter. The keep it simple format is typically the best, especially when it has it's origins in caselaw.
Hope all have a Merry Christmas! I sent the letter of validation and waiting on a reply from this company..............keep you all posted!
Thank you sir! Still in limbo on this as I have not heard back YET. I do realize that the holidays slow things down so I'll be patient Happy New Year!
Right, but sometimes their contracts include a recall on dispute provision (ooops, we're not supposed to know that little detail)... So, the first sign of resistance, the account goes back to the OC, and they're out of the picture.
Did you actually imply that there is a provision that might be in my favor? I'll do some research and educate myself on this tidbit of info! TY again!
You will never know that it exists, you just never hear from that CA again. This is another reason to CRA dispute after you demand validation.
