    Help. I had a Chapter 13 bankruptcy in 1992 and its still on my Equifax credit report. Does anybody know why and how I can get it off. Chapter 13 only is suppose to stay on your report for 7 years and Chapter 7's for 10 years.

    How do I get it off? Can I contact Equifax and send them a copy of the "paid judgement" that I got from the court???

    Help, this is ruining my credit severely and boy have I paid for this over the years.

    I think that is 7 years from the time discharged.

    Welcome to the dark side of chap 13 BK. It is from the discharge date, not the file date.

    That is why Chap 7 is better. The punishment is the same dispite the advertised "features" of chapter 13.

    I have a bk-13 (filed in 1996) on my record. On my Exp. report it states that my bk-13 will be on record until 2003.

    My only advice is to call the CRA and ask.

    FYI...Chap 13 is 7 years from FILING date, discharge date is irrelevant to obselescence period, as long as it was discharged or dismissed. See CRA's sites under FAQ's.

    Experian:

    • Most negative information must be erased after seven years. Bankruptcies remain no more than 10 years. (By policy, Experian removes Chapter 13 bankruptcies after seven years.) Unpaid federal tax liens remain for 15 years. Credit reporting agencies use the date of original delinquency or, in the case of public records, the date of filing to determine when negative information is deleted.

    TU:

    Chapter 13 bankruptcies that have been dismissed or discharged remain on file for seven years. All other bankruptcies remain on file for ten years.

    EFX:

    7 Years, except Bankruptcy-Chapter 13 non-dismissed or non-discharged remains 10 years from the date filed.
