Berks

    i ordered all my credit reports last night and i plan to try to validate, once again, a debt that berks credit & collections never validated last year or the year before. i first was alerted to the alleged debt by seeing it on my credit reports, i was never contacted by the CA. after i sent a validation letter, berks sent me a generic initial contact letter that didn't have my name, account #, or any other identifying information. as a matter of fact, someone wrote SAMPLE across the page. yet they continue to list it on my credit report and the CRAs claim the debt was validated. i'll basically be starting from scratch, but i need to go further this time. i just don't know how far i need to go, who i need to cc on my correspondence, etc. any help will be appreciated.

    Is this someone else's account, an erroneous entry on an account you have already paid, or do you even have any clue?

    What state are they located in, and what state are you located in?

    BBB claims they are a member, with recent complaints resolved.

    on my credit report it looks like a debt that was assigned (the latest report says assigned; previous reports say purchased; i haven't gotten my reports for this year yet) from discover. the discover account was charged off in 2000, and berks started reporting in 2003. but they had me listed as deceased, which led me to question whether this account was really mine. when i contacted the CRA they just updated it so that i wasn't listed as deceased. the CRAs listed different amounts owed for the account, even though they were all run on the same date. the berks account is still accruing interest. last year's report has me as deceased again, but just the berk's TL has that notation.

    Berks is in PA, i'm in Mass.

    they've been sued and lost a few times i believe for violating the fcra.

    i'm still shuffling through papers. the "sample" letter they sent me says, in handwriting across the top, that it was first mailed on 3/3/2003 (it could have been sent to a previous address) and that if i didn't pay or dispute within 30 days, it would be reported to the CRAs. but the opened date on all the CRAs is 3/2003. one of my reports from last year has a TL that shows the status as of 1/2003. can they report it before i've even been contacted or had a chance to dispute it?

    They can report anything, whether they ever contact you.

    The letter they sent doesn't even have your name and the address they claimed it was sent to on it? Was there a cover letter replying to your request for validation? If so, what did that letter say the enclosed letter was supposed to be? Did it include any information specific to the account they claim is yours?

    Although it is their responsibility to have provided validation of the debt in response to your request, at this point do you have any guess what this account is?

    if it really is my account it would be a collection from a delinquent discover account. but i'm wondering if they have the right amount since they have me reported as deceased since 2003. even after i contacted them about the validation. on another note, i did an online search and don't see them as being licensed in my state.
