Best way to clear a Civil Judgment

    OK I screwed up big time and didn't go to the court hearing and got a default judgment against me. I've admitted it was a mistake, now i'm just trying to figure out the best way to fix it.

    I have done some research on here and found the following options:
    1) Try to strike deal with Weltman, Weinberg, Reiss (the collectors), pay debt with them and then hope they take it off my credit report.
    2) Since it seems the Civil Judgement will be on my credit for 7 years, should I File Bankruptcy?
    3) Ignore it and hope they don't renew the judgment in 5-7 years.
    4) Try to cut a deal with CapOne.. if they will even talk to me.

    Do any of these sound like a good option to you guys?

    Yeah....send a pay for deletion letter to the CA. I wouldn't worry about the OC until you get the CA dealt with. As for filing for bankruptcy just because you have a judgement against you.....I would say no because then you would have both a judgement and a bankruptcy on your record for 7 years...but if you are unable to pay your bills, you might want to consult with a lawyer, which sounds like it wouldnt be a bad idea. Cap 1 will more than likely just refer you to the CA if you call them.

    Read through alot of threads on here relative to your situation, just use the search funtion...

    Do you have enough debt for bk,it's not a good idea to file if you don't have enough debt.I would try to settle with them or tough it out.If you have a judgement they can't take it off.You would have to have it vacated.

    That's a new one.. vacated. Does that mean that I would cut a deal, get them to agree in writing, pay it, then go to court to get it vacated? (is that what that means?)
    I don't think I have enough debt for BK. this is only for 3000 (original debt was 950)

    I'm just afraid that i'll pay it and they will keep harassing me or upping the total or just take the money and run..

    also what do you mean by tough it out? can't they keep renewing the judgment? then it will never go away and i tough it out for my whole life? i'm an idiot...

    You should consult with an attorney,he can advise you on your next step to take.nobody said your an idiot,When i said tough it out i meant do this without bk,didn't mean to mislead you.But this can be taken care of short of bk.

    It's way too late for letters now. And as far as PFD, we're talking about a judgment, not a collection or charge-off. Whether or not a judgment can be renewed depends on the state law. How long they can collect on a judgment depends on your state law.

    CapOne is out of the picture. This is a JUDGMENT now. You have to deal with whoever got the judgment. Contact them and see if you can cut a deal. Since they have a judgment, they can garnish wages and/or bank accounts if your state allows it.

    jjgross has given you some good advice--consult an attorney. Most of them give a free initial consultation.
