CA getting nicer since estoppel ltr

    I'm battling a CA (they are the ones who called my former neighbors even though they had my #, then weren't able to validate after my first val letter).

    This new letter (which was hand-signed) says they recd my first letter "offering to set up a payment plan" -- it was the 30 day val letter, not an offer of pmt.

    Also says they will send "the paperwork I requested and that if they can't retrieve it, they will remove the tradeline from my credit, but that the original damaging mark from the CC will remain" -- I think they're right about that, actually.

    Anyway, I disputed every negative item (there were 4) on my report with Equ and Experian.

    I really don't know what I'm doing, but my Exp score dropped 10 pts. when I started disputing.

    If they are responding to a validation letter stating that they will delete the info if they can't get proof, but in the same letter offering to set up payments, then they are in violation of the FDCPA. Once you submit a validation letter, they must CEASE collection activity. I think you should respond with this info and demand they remove it now due their willful violations, and if they don't , they should be prepared to send you a check for $1,000.

    The thing is, I can't tell who the tradeline belongs to... there is no line for a CA on my account, just the addresses for the original creditors with the chargeoff notation. Could a CA take this off even if they wanted to? The date of the chargeoff is long before the collection agency bought the debt.

    As for violations, they have racked up a lot. I am fully intending to take this to court. I want blood.

    Thanks lizardking! I've already asked for deletion from the CRAs. Now I should ask for it from the OC?

    I'm sort of in a waiting mode right now because all my negatives are being investigated. Maybe they will all get deleted?

    No matter what happens with the credit report, I am still taking this particular CA to court for bothering my neighbors and all the other violations--I know they did it to get a rise out of me and they have achieved their goal!
