    How are accounts that have been discharged in bk supposed to be reported? For instance, can an account show as both a "chargeoff" AND "discharged in bankruptcy"?

    Also, if an account was discharged in bk, and the ca and/or oc are continuing to report every month, is this "continued collection activity" considered a violation of the discharge injunction?

    I guess what I'm asking is, once an account is listed as "included in bankruptcy", shouldn't the date it was included in bk been the end of it as far as the credit report is concerned, instead of the account status always showing the current month; i.e., "status as of 07/2002" for a bk that is 8 years old?

    Just a bump for you. I don't know a lot about bks, but I would think that once the bk is filed, the automatic stay goes into effect and that as well as the discharge, should preclude the oc/ca from continuing to report once it has been reported as included in bk. But, as I said, I'm just using logic, not the law as I'm not an expert in bk.

    my experience with bk was that I was punished by my creditors for as long as they were legally allowed to report the included in bk stuff ( 7yrs ). They reported it, and they updated regularly some tradelines were real doozies. ie x times 30,90 days late, charge off, included in bk all at the same time. :( kick you when your down...brutal..
