ChexSystem questions

    Few questions...

    My wife and I filed for Chapter 7 Bankruptcy 4/03, was discharged 7/03

    We included $1,000 overdraft in our bankruptcy with Credit Union.

    We never had NSF or bad marks on ChexSystem files until one merchant finally posted a payment which naturally we already closed the Credit Union account in 3/03 verbally but Credit Union says it requests that in writing (they never told me) but the order to merchant was from 12/02 but didn't post it till 4/03. Naturally we paid that charge to cover NSF few days later.

    Our question is... can ChexSystem leave our NSF in the file even we already paid NSF?

    Other question is.... We're moving to another state next year... will we have problem opening local bank account with only 1 EVER NSF?

    To your first question.....yes. Paid or unpaid it is an accurate description and stays on your file for 5 years.

    As to your second question....yes. Your best bet is to send a dispute letter in to chexsystems. Bank drags their feet, you get a deletion. If this happens open that account somewhere and fast. Sometimes the deletion is only temporary and will be back on if the bank was late in responding.

    The only other way to get around this is to pay bills by money order. I did that for 2 years before successfully clearing up my report with them.
    Oh, and by the way, banks can't report you to chexsystems if you paid the transgression within 30 days.

    Huh? what does that mean? we paid our NSF within few days after we got the notice of NSF in the mail and told them to transfer whatever's left in our savings ($25.00 left) to cover $20.00 NSF which they did.

    How do we dispute that we did paid NSF few days after they mailed the notice to us?

    Can you be more clear what that means? thanks!

    Yeah I'll certainly try...

    The 30 days starts from the date of the NSF.
    Not the day you get notice.

    Chexsystems will tell you that in order to be reported to them the debt/NSF/Check kiting/fraud of any sort must have been unpaid for more than 30 days.

    If you indeed paid this before the 30 days is up. Send the dispute letter to Chexsystems along with your proof of payment showing the date paid along with the date of the entry onto chexsystems.

    This should be enough to get it deleted.

    In fact, I'm a little uncomfortable about this one...before you do anything let me do some research. My own experience with this suggests that I'm right. Best to be sure though

    Most banks will not report you if there is no outstanding debt owed to them beyond 30 days after the account is closed unless the account was closed due to fraudulent activity.

    If I was reported every time I had NSF I'm in big trouble. Hope I wasn't.

    I'm so getting the Everbank no fee overdraft. In combination with CashEdge I'm hoping to never pay a monthly fee, a late charge or a NSF fee ever again. Any overdraft interest will be peanuts in comparison.

    I had never even heard of Chexsystems until last week when my fiance tried to open a new checking account. Came here and asked where the heck the bank was getting info, they told me about Chexsystems. ordered the report immediately.

    There is one, yep, count 'em, one, NSF on there from 9/1999. That's it. No inquiries, no nothing and we were denied opening a checking account.

    My fiance tells me that the reason this is even on here is because he disputed an NSF charge with this bank. They wouldn't remove it so he closed the account and didn't pay their charge. They also tacked on other funky charges, don't know what for.

    If the 5 year limit is true, then it will be off in almost exactly one year.

    Meanwhile, I will go the validation route.

    But I notice they have drivers license number on the report. it's accurate.

    does anyone have experience/succes in validating/deleting things from Chexsystems?

    No DL information
    No bounced checked
    No check ordered information.

    Should i be concerend or just greatful? ( I never bounced a check in my life)

    You should be thankful.

    But to answer the last persons question. I have successfully fought and won with chexsystems.

    I obtained a copy first of all.

    Then I sent dispute out to them about 1 bank showing a NSF. At the same time I sent a letter out to the bank asking for mercy and explaining myself.

    The Chexsystems came back verified.

    I then called the bank and talked to a lady who said she would send a deletion request due to my explanation of NSF activity.

    Then for the other 3 NSF on my report I sent in a dispute. These were for a bank which at the time was called Old Kent. I had an advantage because my paid NSF was from 3 years prior and the bank had two mergers since me!

    It came back as unverified and was deleted.

    On the 32nd day I called to verify deletion with Chexsystems, which they did verify and I immediatly went to 3 banks with 50$ each and opened a checking account with every one of them.

    I was so mad at Chexsystems and mad at the "system" that I did just that.

    But it back fired on me with one of them so beware.

    The first bank I opened an account with sent me a letter stating they were closing my account. I called and they offered me the following explanation:

    "We received notice from Chexsystems that you had tryed or were successful in opening up 2 other accounts in the area." "This looks like a check kiting scheme and our new accounts board has decided to close your account".

    WTF!!?? I was ticked off, but not discouraged. Screw them and chexsystems. The other two banks have said nothing about any "notice" from chexsystems and have had them now for several months.

    Maybe it wasn't and they created a new file with just his name and SSN when he asked for a report instead of saying they didn't have one? Just a guess.

    I think I may have reported myself to chexsystems. Be weary of ordering a report!.

    It lists my current NYC address, even though I only recently moved here 6 months ago. No previous addresses (in other states)
