CHOD: icalled eq & just called FTC!

    ok im super pissed off now

    i called equifax and spoke with steven team a... he said they have an extra 5 days to process the investigation per the FTC..

    i ask for a supervisor

    sheila team c supervisor says the following:
    if it was done via phone its 30 days, via mail is date of receipt plus 5 days to allow for processing the mail. she said and i quote "the ftc allows us the extra 5 days to process the mail"

    she told me to call the ftc

    i call them... nicolas answers.. i explain to him.. he says "30 days and 30 days only"

    im now calling eq back and going to do a 3way call to see what they have to say...

    carolyn team 2 manager wont do a 3way no matter how much cash i offered HAHAHAH sorry bad joke

    anywhoo im now on hold while she goes to the FCRA to find the 5 days rule...

    ok im now looking at the fcra about disputes... says they have 5 days to notify the creditor about the dispute... not 5 days to process

    this is stupid

    i prob wont sue tho i would like to since they are just right up the street from me

    spoke to carolyn team 2 supervisor

    says "fcra says 5 days in this section:
    she said "i am not an expert on the fcra, but we will not violate it... it says 5 days, we get 5 days"

    I got exactly the same story from the today. Idiots!!!!!!!!!!!!!!!!!! :)

    allen, remember a couple of days ago I stated this very thing? And somebody gave a real smart remark about how I was wrong? Like I said in that thread, I do not think that it is written anywhere but that is what the CRA's claim. And like LKH stated, if you persue them for a violation on 5 days you can look forward to them marking any future disputes as frivilous.

    I would have made the FTC guy the first call, then added Equifax as the 2nd call - no available options there, other than hanging up on you, with the FTC as a witness to their poor customer service ;-)

    its just amazing to me... if i get bad service at mcds, i go somewhere else... with credit i have no choice

    i will not persue it as it is only right now for removal of the emerge tradeline...

    blah i say!

    tnobles, do you think I will be marked as friv. for speaking my mind to the manager? :)

    I wouldn't think so? I do not know that you would be marked frivilous for pursuing it, that is what LKH thinks, I have never done it so I don't know. And I am not saying you should not pursue it. But in my opinion legally speaking I just don't think there is much there.

    That 5 days is for the CRA to provide notice to the furnisher of information about the dispute and has nothing to do with the 30 day investigation period.

    The only extension they get is if the consumer provides additional information relevant to the investigation.

    I am at that point also. It gets real old real quick. But after feeling that way, the cra's or a creditor will do something to make me mad and it puts the fight back in me.

    gib.. i READ the woman the section that she found.. both of the supervisors said

    "the paragraph states we have 5 days, i am not an expert but that is what it says"

    bottom line is calling will do no good. they have 5 extra days.

    there is nothing we can do

    ..And by using the same logic, since the fcra mentions the word "delete" several times, Allen gets one.

    Sheesh. "Not an expert", yet a supervisor? What a moron.

    I can feel your frustration from here! I HATE stupid, yet stubborn people. Perhaps you should walk over, and give her "her sign". (And then, unload all that water you drank into a couple of open car windows...)

    I'm not disagreeing with you allen, I too have had some less than intelligent conversations with Equifax CSRs. There is something you could do, but unfortunately small claims judges don't seem to be much brighter than EQ representatives.

    I would make sure I followed up with a complaint to the FTC though, if enough people filed complaints they would take action. I know this doesn't help you, but maybe it could benefit someone else down the road.

    I got this exact responce from two agents, supervisor, and their manager. Manager (Carolyn - team 2) said that she doesn't have FCRA in front of her, but since they are govern by FCRA they wouldn't ever violate it :) HA HA HA.

    I am going to wait another 5 days and call again. If it will be delted - fine, if not ( I have this strong feeling that it will magically be verified tomorrow) I will send a letter to their Consumer Affairs and after that will folow with a lawsuit
