Funny how they make most things seem as "frivolous", but a serious about face in the following quote:

Regardless of the resistance that I received, I still learned quite a bit. I saw that many of the consumers that either want to sue or that are suing agencies have a legitimate belief that the agency did something wrong. I also saw that many of the situations came about based on a technical mistake that was made by the agency and also, the technical mistake could have been avoided. Even if the lawsuit isn’t successful, it will still cost the agency something in the long run, even if it’s just time. As we know though, time is money.
Oh, yea..been gone a while. Down to 4 boo boos on the report, with 2 different accounts. One is in small claims right now, the other soon to be erased.

No, it is not Kay Kay. Bill Lindala joined ArtofCredit and did his posting there. He and I e-mailed back and forth a couple of times and he and I have had our differences of opinion on CI.com also. He is definitely not KayKay.

Can someone please define "technical mistake" by collection agencies' standards?

As in: "We made the technical mistake of calling the debtor at 2 in the morning and telling him that the Sheriff is about to arrest him on a warrant for criminal activity related to non-payment of a $45 cell phone bill and $600 in 'administrative fees' that we added to it"?

Sorry, couldn't stop myself.

I’ve had more than one CA throw out that I have them on a “technicality” and that’s the reason that they are deleting the trade line. The response to that, of course, is that the enforcement of my rights as a consumer per the FCRA and FDCPA are not mere technicalities. Instead, these rights are the only protection that I have against CA’s who don’t choose to comply with the law, and exercising these rights are the only way to ensure that they do so in the future. Of course, they all think that I’m a NUTCASE, but heck, that’s all I wanted to begin ;-)

BTW: Another item gone bye-bye, this one with just a phone call and a agreement to pay in exchange for a deletion. This leaves just one item on two reports (Syndicated Office Systems aka Central Financial Control aka Tenet Healthcare). The small claims court date is coming up in October, so I’ll let them sweat it for another week or so before I send them a settlement offer. Otherwise, I’ll see them in court in my little county courthouse here in South Florida (I doubt that they’ll showup).

BWT 2: Ignore the scores, I'm too lazy to update them, although they are in the high 600's now ;-)
