Do i have grounds to sue CA???

    Okay here is the ????

    Pulled credit reports and noticed two accounts in collections with same CA for 32.00 and 29.00 from some pathology group.

    Sent validations and the CA sent me a printout for the 32.00 on the pathology groups stationary dated 3/6/02 but the CA placed for collections on 12/00.

    Nothing was received for the 29.00...

    Sent estoppel and still got the same response for the 32.00 and nothing for the 29.00...

    I called the pathology group and stated there were two accounts they placed for collections.. They started checking and said sorry Mr. XXXX the 32.00 was an error and should have never been sent we will contact CA to remove and they dont show me owing anything for 29.00..

    Ive sent several letters telling the CA this but they ignore... I sent the ca an intent to sue cause they did not report to CRA that the accounts were disputed, they never validated the 29.00 or the 32.00 for that matter, and when i disputed with CRA both accounts came back verified which according to ftc opinion letter by cass constitutes collection activity right???

    i do have grounds to sue correct???

    any input appreciated

    I would make this double and nail them for each account .

    Thanks for all the replies...i just again talked with the pathology group and found out that the 29.00 account was also sent to the ca in error.. i also asked what they sent to the ca and the rep stated they have sent two letters to the ca stated they sent in error and to omit the the tradeline from the report...

    i know the the ca's are just gonna mark the accounts a paid collection and ill have them on another violation..

    i also have an am ex denial letter stating the derogs for collection...

    ue both the pathology group and the ca.

    that's pathetic.

    Make sure to apply and get denied NOW while the items are still on your report. A local company is better (bank) as you can subpeona them to your local courthouse if push comes to shove, although it likely won't go that far :)

    1. apply now for credit and get denied
    2. Get letter from pathology stating no debts
    3. send demand letter if your state requires it
    4. file lawsuit

    :_) Have fun. Get the pathology group to fax it to you first so you have it in hand :) You've got some money coming to you
