Does hard inq = collection activity

    Does the act of pulling a credit report (hard inquiry!)twice in one week by a collection agency count as continued collection?

    If they were in receipt of the validation request and had not yet validated did they screw up by hitting my report.

    At first I thot they might have a legit reason to pull the report since we have a(n unholy) relationship.

    BUT - should't they know what's on the report - they put it there after all and
    in their letter they say " we have initiated further collection efforts..." and then they say their efforst including obtaining my credit report. Seems like they view pulling the report as continued collection - so why shouldn't I (and the judge for that matter!)

    DISPUTE IT AND ASK QUESTIONS LATER!!!

    They could do a "SOFT" if they wanted...but a "HARD" is called "TAINTING" your credit report...

    You said you sent them validation? If so, then I would consider this collection activity-- they already have your address for goodness sakes. If you have to send a second validation letter, include the following:

    It has also not escaped my attention that you have accessed my full credit report through multiple hard inquiries at the credit bureaus, the most recent being xxxx. These hard inquiries are considered collection activity and are not permitted while validation is in progress. You should also understand that if you cannot substantiate your claim with proper documentation, then you do not have â??permissible purposeâ? to obtain my credit report as defined by the FCRA, section 604. Therefore, until you provide me with the required documentation to substantiate your claim, each inquiry you make into my credit file will be regarded as a violation of the law and these violations will also be reported to the FTC. These non-permissible inquiries may also violate my rights under other federal and state privacy laws which may subject you to additional civil penalties.
