    Update: This gets better...

This account doesn't exist! It's a combination of his other two loans and should have been removed from his report when the loans went back to the National Repayment Center. I need to find out who Direct Loans is. Are they they OC, no, I don't think so. FDCPA? Lawsuit? Damages?? We can't get a mortgage right now... Help!! TIA!!!

Ok, yes they are the OC. Duh, it's the Gov. Caught up in the moment...

    This from their website..

"Direct Loans are never sold. Since borrowing is direct through the federal government, borrowers make loan payments to the Department of Education for the life of their loans. It's "one-stop-shopping" from loan application to repayment."

Ok, DH just talked to a lady from The National Repayment Center (I know, bad! These are paid though!) and she said, "when the debt was sold to us, their TL should have been removed from your report". She laughed when he told her that they verified with the CRA.

So Direct Loans is the OC that verified a bogus TL. FCRA w/damages? This TL should've been removed in 07/02 when the debt was "sold".

The National Repayment Center (NRP), is a third party collector. I'm sending validation letters to them. I would like to know why they decided to offset his taxes an extra $1250.

NRP is sending out a letter stating his two loans are paid in full and were paid on 05/05/03?!?! I can't wait to see this! They were paid 04/02!LOL! These loans are reporting paid w/EX and EQ. TU is reporting two of them w/wrong amount and a balance. They all have this other erroneous loan that I mentioned above.

We need this off his record, ASAP!! We're trying to buy a house.

    TIA!!

Well, we just went from bad, to worse! The CA just updated dh's TU report. They deleted the two loans and now have them listed as one loan w/a balance of $1444!!! This is the CA that is sending out a letter of proof that his loans are paid in full! So, they put this BS on his report!! Validation letters have already gone out to the CA. So much for a loan this month! FHA wouldn't touch us w/one seemingly unpaid gov loan. Now we have two!!! This sucks!!!

Does this letter look ok for the OC/Gov??? Would you send this?

    "Dear Sir/Madame,

I have recently received a copy of my credit report. My Experian report has an account listed as, â??Status: Claim filed with government/Past due 180 days. $909 past due as of 4-2000. Credit Limit/Original Amount: $4683â?, with your department. I disputed the account with the credit bureau, but it recently came back as verified.

I hereby advise you that I am not requesting a "verification" that you have my mailing address, I am requesting a "validation"; that is, competent evidence that I have some contractual obligation to pay you.

I am writing this letter to you in an effort to have this erroneous information removed from my report. Please delete your information from all three of my credit reports.

This is a written dispute of this account per the Fair Credit Reporting Act § 623 [15 U.S.C. § 1681s-2]. Please be aware, I am exercising all of my rights per these laws and all other applicable laws protecting me.

    Regards...."

Does this look ok? I really need some guidance here.... TIA!!!
