FDCPA violation letter sample

    Does anyone have a sample letter to send to a CA regarding a violation of the FDCPA? NCO cashed a postdated check of mine without sending me a notification before submitting the check which clearly violates section 808. I got into it over the phone with one of their b#*ches today and I want to shove it in their face. Thanks in advance.

    Why? Just sue them. That will be much better.

    Also, complain to the FTC.

    You think I should just go straight to court without sending them a letter spelling out their violation?

    Yes. Make sure that you let them know that you will drop the suit for payment. That gives them an out.

    Just out of curiosity, how far in advance did you send them the check? Did they cash it earlier than the date it was dated for?
    If you sent them a check more than 10 days in advance and they failed to notify you 10 days before cashing it, how will you be able to prove when you sent them the check?
