filing today. need a few pointers

    Ok I am filing suit today against UCB. Our small claims is only $3000 dangit. My first question is- who do I file against? I am in the same state as the CA. Do I file against the company or their registered agent and if it is the agent to I use his listed address or the address of the business? Also, can someone point out what I need to do when I get there or what information I might need. Thanks

    Does anyone know? I am filing in 2 hours. Also, I sent the validation request in my wife's name and it is on her credit reports only. However, come to find out the collection is on both of us- me for going to the hospital and her for having the insurance I used. Do both of us have to file a suit or just her and if it is just her can I do the talking as I know more about this stuff.

    Each court has different rules. I filed yesterday in Colorado. Our small claims limit is $7500.00. I filed against the company, but had to list the registered agent.

    Filing Fee $24.00
    Cost of Service $31.00

    Watching the CA squirm Priceless

    For everything else there's Mastercard

    Who did you end up filing against? What happened?

    I filed against the Collection Agency. They gave me a court date Next month.

    I am gonna file today. I am just making sure I have everything done the right way. I still am not sure if both my wife and I should sue or just my wife. She sent in the validation, she has it on her credit reports, but the bill(we recently found out) is in both of our names. I would do better in court because I know more about this stuff.

    You and your wife should be listed as plaintiffs, because both of your credit reflects and affects on one another.

    You would be the co-plaintiff.

    You can do all the talking and she can just agree with everything you are saying.

    You and your wife file seperate cases at 3000 Ea.

    Obviously I missed it, so can you tell me what the violations are that you are suing for?

    Also, if you haven't filed yet, you can list it as:
    Mr. and Mrs. picantel vs. UCB c/o registered agent.

    They said they sent a settlement letter last thursday and I am holding off until I see what it says.
