Getting a judgement removed?

    Long story short: Back in 2000 I was laid-off and unemployed for a year. During that time I basically lived off my credit cards, which left me a whopping $25k in debt.

    After I got another job, almost none of my creditors would work with me to lower the interest rates (which rocketed due to late payments, etc) so I just walked away from everything and let the chips fall where they may.

    About a year ago I pulled all my credit reports to see where I stood. Needless to say, it ain't pretty. But I've spent the last year disputing items and I've gotten rid of a lot of them.

    The nastiest of what remains is a judgement from the state of California from 2003 (they say they overpaid me $300 in unemployment compensation because they sent me a check the same week I started my job in 2001). I never received notice of being sued, but I can't say it was never sent -- I moved a couple years ago and did not have my mail forwarded. I have disputed the judgement twice over the past year and it has been verified.

    Here's the first of what I'm sure will be many questions I'll have for you all: I'm more than willing to pay off the judgement amount (I have the money) but how can I do it and also get the judgement vacated and removed from my credit reports?

    Since this is the state of California we're talking about, I can't really do a pay-for-delete. They already have an order for garnishment but they've never been able to collect because I'm a tipped employee so my paychecks are next to nothing.

    Any advice would be most appreciated.

    I do not have any advice but I also have a judgement and would like to know what to do to get it removed also. Thanks.

    JMTS are reported by the court in which the jmt was obtained.. On a civil jmt you would normally contact the attorney who filed the suit since they are the one who files the "satisfaction of jmt" and then only the balance is updated.. What I would do is contact the court and/or attorney who filed the suit. Then advise them of the situation and ask the attorney if you paid the debt in full would they remove it completely from your credit, not just file a satisfaction of jmt.. Get it in writing though if they say yes..Reminding them that they cannot garnish you might help them decide to just take the payment.

    You may be able to have it vacated if you were not properly served.

    Others may be able to give you more info, but I think you go to the courthouse where the judgement was filed and fill out the Request to Vacate paperwork. Your request will be reviewed by a judge and he/she will render a decision. If you weren't properly served, you have an excellent chance of having it vacated.

    I too have a questions regarding having a judgment removed/vacated.

    I owned property, the Association sent me to the Attny, I have 3 judgments (all are paid), but the Association has since hired a new Proprty Mgmt Co. (who uses a different Attny). What are my chances of gettng the judgments removed since the old Attny no longer has the paperwork (I called and was told I need to talk to the new Property Mgmt Co.) I pulled my creit reports yesterday Trans Union on has 2 of the judgments listed. Experian has 2 listed, and Exquifax has 3 listed.

    My question is if I say they are not mine and the CB tries to investigate them, the old Attny can't verifiy it, do you think they would try to further investigate them (keep in mind - they Are PAID IN FULL)?

    I think its the court that reports the judgement info there is no more verification or anythign like that I believe. The court has ruled on it and thats that as far as the cb is concerned. Now if you can somehow get the court to vacate it then yeah it would disapear. But the court doesn't have to verify to the cb.

    I am not an expert by any means though so I could be wrong about any of that.

    I just called the court, I was told that I had to write a letter to dismiss to the judge for the 3rd one that is only showing up on one of my reports.

    But the Attny no longer has the paperwork. She told me to put that in the paperwork. I am like UGH!

    I asked about getting them vacated and she said why? They were satisfied. I left it at that.
