Good News and Bad News

    I'll start with the good news first. My Transunion report is now clean! HOORAY!!! Providian removed the 90-day late (which was the only remaining negative on there) and it is now clean! Believe me! I'm happy about that!

    However, my Equifax report has taken a hit. It too was clean but my paid chargeoff from GECC is back on there. BUMMER!!! The reason I know is because I subscribe to Equifax's online watch and I received an Email advising me of the change.

    Is there anything I can do? I don't know if Equifax actually verified the account or if my creditor made the reinsertion. The confounded thing is over two-years old and I sure would like to be rid of it, once and for all.

    PLEASE! If anyone can offer advice or suggestions, I'm eager to listen.

    They're (EFX) supposed to send you a letter telling you they reinserted this. When you get it, request the verification process that they used - ala Marie's posts. They have to tell you who they talked to and how they determined that it should be reinserted. All reinsertions must be certified as accurate under FCRA.

    Donna, congratulations on the TU success.

    I don't have much advice to offer re the Equifax entry, but just wanted to let you know that I'm in your corner and hope that this will be permanently removed.

    It may help to follow Marie's approach ("CRA's busted" thread) and demand to know who verified and how. If you bother them enough, they will probably delete it.

    Thanks for responding to my post. I very much appreciate your advice and support. It's always comforting to know you're not alone when you're fighting a battle.

    To date, I haven't received anything in writing from Equifax about the reinsertion. You can bet, though, I'm going to shout, scream and fight! Until that confounded thing is removed!

    I'm going to read Marie's thread again. And, if I do receive written notice from Equifax concerning the reinsertion, I'll be asking questions about the verification process. I'll hound Equifax until they are sick of me! This negative has reappeared and I want to know why!

    As details unfold, I'll keep you posted.

    Thanks, Breeze. I'm definitely going to look at Marie's thread more closely, taking notes in the process.

    At this point, I don't know if I should dispute the reinsertion now or wait until I receive the formal notice from Equifax. What could it hurt to go ahead and challenge the item now.

    Hey Donna...that TU news is INDEED good news.

    I had something re-inserted onto Equifax and I NEVER EVER got a letter saying why.

    I sent a certified letter to the collection company and I get a letter in the mail today...it was returned and I have to go pick it up at the post office.

    Hey, I tried to pay. NOW, I'm going to write Equifax and ask they re-investigate and tell me name, address, etc of who verified this info. Else, I want it removed.

    Is there anyway (LK) to have it NOT come back?

    I'm sorry the same thing happened to you. Frustrating! Isn't it? *Finally* you think you're out of the woods and then you're not.

    Anyway, I'm planning to use a strategy similar to yours. I'll hound Equifax until they either delete the account or come up with some legitimate verification info.

    You keep me posted and I'll keep you posted.

    Congrats on the TU report, it is nice to see a person have a clean report that deserves to:)


    Sorry to hear about Equifax, I would follow the others suggestions and read Marie's post.

    That's great news on your TU. I'm sorry to hear about your EQ.

    I posed the question on another post over the weekend asking whether an item once deleted in dispute mode, but comes back with the monthly updates if you get a letter from the CRA letting you know it was reinserted or whether you just happen to find out by viewing an updated report. I was told whether it is a dispute reinsertion or it just got put back on when the monthly tapes from the creditor came in that you were supposed to get a letter within 5 days of the reinsertion. To me it looks as though Donna's account probably came back during monthly updates and I'm afraid she will not get a letter from EQ.

    Now is this a loophole that the CRA's can use to avoid sending a consumer a letter? How does the CRA determine whether it is a reinsertion or an update? To me this would seem a violation of the FCRA. How many times does something get reinserted and no letter goes out; how many times the CRA's violate the FCRA in this respect. If there is no letter sent to Donna, along with suing on the violations Marie stated, Donna could go after EQ for this as well.

    I agree with the advice given above that Donna go through the verification process and pursue this.

    Thanks, the packing is done, now I just have to find curtains that look nice and hang some pictures and things on these bare walls LOL.

    But again congrats on TU and I am very sorry about EQ, but I know you will work this to the end until it gets resolved once and for all, but sorry you have to go through all this with EQ.

    Believe me! I do intend to keep after Equifax. I'm just glad I'm subscribed to the online watch service so I could keep updated on what's happening.

    You've certainly had your battles with Equifax, I know, and they weren't much fun. Now I guess it's my turn.

    I'm glad the unpacking is finished. When I moved the last time, it took me three months to empty out all of the boxes.

    And shopping for curtins sounds like fun. I hope your search is successful.
