Great info in the Unoffic FAQ's and

    WOw! I've been on the boards for about a month now, and never saw the Unoffic FAQ's and letters section until recently. I feel like an idiot. But, hey , now I know. Like I said I've been reading and learning lots. I've read and re read the Goodwill ltr & the Nutcase ltr. I've made some revisions to fit my use for the following. I'd like some feedback. I think I'm on the right track, but want to make sure before I send it. Let me know your htoughts! thanks in advance!

    To Supervisor:

    My letter dated, 7/17/03, submitted via email has gone unanswered (see attached). It has been more than 30 days; ample time to respond. Today I called your Financial Services department at 1-866-266-1445 and attempted resolution to an issue with inaccurate information being reported on the credit bureaus.

    The representative I spoke with, named Julia at x 2151 researched the account, said she spoke with a supervisor who accessed the account, and said that the account was paid in full in 1997 and that the next department she transfers me to will issue me a Paid in Full letter and furthermore since itâ??s been 7 years since the account was paid, she would instruct them to contact the credit reporting agencies for deletion of the tradeline. She said she would relay the information to the next representative. Although I donâ??t believe she did. Although I was able to speak to the next representative, named Sam, at 1-866-265-1822, he was unwilling to issue me a paid in full letter on the account or delete the tradeline (per my request). Furthermore, he said that he only has the capability to mail information to me. Please note, this is the complete opposite of what Julia stated in my conversation with her. I then requested to speak to a higher level supervisor. He said he would transfer me but instead sent me to a voicemail. I attempted to leave a detailed voicemail for a supervisor and unfortunately the voicemail system cut me off.

    I then attempted to call Julia back at the above mentioned phone number to again, try to resolve the issue. The individual I spoke to said that she could not help me and that I would need to speak to the Belleview center. I was transferred again to the Financial Services phone number.

    Let me once again remind you that this account was paid in 1997. From that time until November 2002 it showed as unpaid on the credit bureaus (unknown to me until recently). I am sure you will agree reporting such inaccurate information is in violation of the Fair Credit Reporting Laws. Furthermore, when I recently pulled my credit in July 2003, the account is now showing a balance of $52. What is going on ? This too is a violation of the Fair Credit Reporting laws.

    Let me once again outline what action needs to be taken. Since you have not validated the above referenced trade line within the time frame given - you are to immediately delete this incorrect account, in the form of an universal data form, from the three major credit bureaus (Equifax, Experian, and TransUnion) and fax proof of the deletion to 602-268-6832 immediately!

    Also note, that section 1681s-2(b) of the Fair Credit Reporting Act creates a cause of action for a consumer against a furnisher of erroneous credit information (Nelson v. Chase Manhattan).

    Please be advised failure to comply with my requests will result in a lengthy, long and expensive legal battle with your company. This matter can be resolved without such action.

    For the purposes of 15 U.S.C. 1692 et seq., this Notice has the same effect as a dispute to the validity of the alleged debt and a dispute to the validity of your claims. This Notice is an attempt to correct your records and any information received from you will be collected as evidence should any further action as necessary.

    Too much verbiage. Keep it short and simple. get right to the point. A letter that is too long will get tossed to the side in this hectic, fast-paced world.
