Hard question..Gurus please??

    I hava a charge off that's listed under B of A. This is not the original creditor.
    It has resisted all efforts to remove it from all 3 cra's. It's showing up as a paid charge off. It's not paid. A lawyer CA has been trying to collect on it
    and has not answered my CRRR validation letter.
    I sent them a second val/c&d letter a few days ago
    and no response so far. The CA is saying that they are trying to collect not for B of A but for another bank that is not reporting, WTF ??!!.
    I need to get this derog off my cr's to apply for a
    mortgage. So far, my only thought is to send B of A
    a nutcase letter. Any other ideas ???

    Well, I'm not sure I'm a guru, LOL, but your question isn't too way out there for me to answer.

    Calm down, take a deep breath. You just need to continue down the debt validation procedure as posted here and on other sites. You are doing fine. Don't let them deter you. They may have made a mistake in trying to collect on another debt that isn't yours.

    In any case, if they are saying it's not BofA and you don't know of another chargeoff, then obviously, the CA won't be able to provide validation and OFF! it goes.

    However, the CA is not reporting. I'm not really worried about them. Unless I didn't understand your answer, how can I ask the cra's to delete if the CA
    says they are not with BofA? The account numbers match the CA and BOFA but they have never mentioned B of A. They do say they represent the
    OC but the OC is not reporting. The OC was Nations
    bank. The new "alleged creditor" is Midfirst bank, I've never even heard of this bank. :(

    I think that Bank of America took over Nationsbank a few years ago. My visa from Nationsbank changed to Bof A but where I live now doesn't have any BoA branches so I haven't followed their transition. Others here will know though b/c they live in BofA regions. Haven't heard of that other bank Midfirst. Sounds like your debt w/ Nationsbank is pretty old though.

    It is very old and I think that this BofA charge off is
    a re-aged Nations bank C/off. I think that maybe
    my Nations bank acct was already in delinquency
    before it became BofA. Maybe I should start by
    attempting to validate BofA ??

    have you read the "validation must reads" thread. if so, please read it again. LK used ALL of his techniques on OC chargeoffs. . . also start contacting the AGs of your and BofA's state, and the BBB, and the Comptroller of the Currency. Even if they say they can't handle such complaints, keep bothering them. Eventually, that tradeline will go away . . .
