my first post (after doing 'bout an hours research on the site) so be kind.

I used to be a bad boy and racked up $8k in credit card bills and bills and one day simply stopped paying. Never talked to the creditors or collection agencies again.

That was 6 years ago. I finally opened a checking account, and an INGDirect account. I am sure my credit report is shot, but I really do not recieve the collection notices that I used to. I think just from one collection agency now (maybe 2). I think that a lot of my debt has been wrote off, but I don't know how to check really (early today I applied for a credit card so I could be rejected, so that I can get a free credit report.) How can I find what debt I am liable for and how much has "dissapeared" so that I can work towards getting my credit rating back?

I have read around this site for over an hour, touching on litigious mindset and Validations and FAQ's, but I want to see the debts that I am liable for BEFORE I start on the warpath. That is basically my main question: HOW CAN I FIND WHAT DEBTS I AM STILL "LIABLE FOR"???

I am also wondering about hte statue of limitations, and when it begins, and how long it it.
I also found this for my state, California but I cannot decifer it:
    STATE: CALIFORNIA (%)

    INTEREST RATE
    Legal: 10%

    Judgment: 10% (Unless otherwise contracted)

    STATUTE OF LIMITATIONS (IN YEARS)
    Open Acct.: Reduced to writing-4

    Open Acct.: No writing-2

    Written Contract: 4
Domestic Judgment: 10 (renewable at 10)
Foreign Judgment: 10 (commencing with judgment debtor's commencement of CA. residence.)

    BAD CHECK LAWS (CIVIL PENALTY)
Amount due, Treble damages - minimum $100 maximum $1500 per check

    GENERAL GARNISHMENT EXEMPTIONS
See federal law. Exemptions for necessaries of life.

    COLLECTION AGENCY BOND & LICENSE
    No license or bond required.

    Thank you for your help.

If no one has sued you, I think you're home free. The first thing you should do is call 1-888-5OPT OUT - so they can't sell your name to collection agencies who purchase lists of people applying for credit so they can find you and start trying to collect from you again. They NEVER stop trying.

Then get a copy of each credit report and see what's on there. Most of them should be gettig close to falling off your report automatically.

choose one of the options for getting a free report. shouldn't be an issue.

What this means is that if they haven't sued you by the 4th year of the charge-off, the can't. You'd be better off waiting another year and everything should be off your credit report. The statue of limitations in California for credit card debt is 4 years. That's the amount of time they have to sue you. After 4 years, they can continue to report on your credit for 3 more years (for a total of 7 years).

You should wait at the seven yrs mark when the negative information will be removed automaticaly from your reports to apply for new credit. If you apply now the colections agencies will notice your new address and tel number from your reports (on your applications) and find you again.
My suggestion. wait 1 yr more.

I guess I am better off than I thought.

I really didn't want to apply for a card today, but I think it was my best shot at getting a credit report to look at because I do not have any credit card (required) to "suscribe" to those services for 1st month free to get my credit report, and I do not have $30 to pay for all 3 reports, and I felt there was NO WAY that they would even consider aproving a card for me. Thankfully, I used the old address and phone number! lol

Thanks a lot for all your help and infromation on my situation.

and I am gonna definitely call that opt-out number.

    WOW, I feel better already!

A drop is all I needed to ask an intelligent question. ;)
I just needed a little direction. I have put in about 4 or 5 hours as of now, but in reality, my college studies are more of an immediate demand than spending weeks ormonths pouring over debt stuff that hasn't been touched in 6 years. And thanks for keeping the links in your sig. I saw them before I even posted and they are quite helpful (BOOKMARKED)

again, I would like to thank everyone who took some time to post here! I really appreciate it!

    lkyoldson,

I know of several people that just walked away from their debts and never got sued. Some as much as 80k. I have a friend that does it every three years.

Once you start getting copies of your reports you'll awaken the collection agencies that you still exist.
So you can expect a few bottom feeders to send you a few letters. They normally go away with a Validation or Cease and Desist letter. At least, this has been the case for people I know.

If you prefer to wait 1 more year you can, in the meantime, get a ATM card with the Visa logo and it works just like a credit card so you can shop, travel, etc. without carrying cash everywhere.

I don't see how getting a copy of your credit report is going to awaken the credit agencies that you exist.
When you get your own report, the CAs aren't notified. If they pull your report, they don's see the soft inquiries to see you pulled your own.
The only way they are going to 'awaken' is if you contact them or dispute something.

Well, you should take a look at these products offered to the collection industry by the CRA's.

The OP should keep records as accurately as possible so that any future re-aging done by the likes of junk debt buyers Sherman, RMA, Asset Acceptance, etc. can be brushed off and/or sued upon in counterattack.
