    Recently I have been contacted by an attorney concerning an account that had been screwed up by a creditor (Bank One) who took my account from my original creditor. The original creditor Wachovia
    had the account for over a year and I had no problems with them at all.

    Wachovia sold the credit card account to Bank One and my problems began.
    Bank One added some sort of account insurance without my consent and threw my account over limit causing addtional charges to hit the account.


    I contacted Bank One and they told me not to worry about the accrued charges or fees just to make my normal monthly payment and an adjustment
    would be made on the next bill.
    None of this of course happened except the part where I made the regular monthly payment.
    I contacted them again and was told the same as above.
    The credit was never put on my account and I finally explained to the creditor
    that they would receive their next payment when account had been fixed.


    In the mean while before this dispute with the account could be settled, it was sold to another financial agency. Chase financial services. The attorney now is claiming that First USA Bank was the original creditor and that
    an account that was setting with a balance of a little over $2000.00 has grown to over $4000.00.

    I have never received anything from First USA Bank. I have never heard of them and my address has not changed.

    I have sent the attorney a letter requesting validation of the account.
    The attorney responded by letter that an associate from First USA Bank
    had a notorized affidavit that this account was valid. We received no validation for this account what so ever.

    We are lost as to what to do next???

    Any help in this matter will be greatly appreciated.

    First of all, FirstUSA bought Bank One, and FirstUSA was subsequently bought by Chase. That's why Chase and FUSA appear.

    Did you dispute the charges in writing? That's the only way to preserve your rights. You should also have kept making at least the minimum payment while everything was sorted out. A little late right now, but something to remember for the future.

    Right now, I think you need to write out everything that happened. Did you keep notes of when you called and the name of the representative you spoke with? Get your records together and let us know what you have so we know what you're working with.

    Should have made a dispute per the FCBA as Hedwig states. Right now, there isn't a whole lot to deal with that Hedwig hasn't already outlined.
