I guess 1 Million Wasn't Enough :)

    Received a dunning letter from Nationwide Credit in August. (This was also a subsequent CA - previous couldn't/didn't validate).

    Sent out validation letter WELL within 30 days. It is on DH's Experian report as of today - they have not validated.

    In 1998 the reached a consent agreement with the FTC for 1million civil penalty for just this sort of thing. A few months ago, they dunned me for Amex, but went away, because at that time they were not bonded in TX (guess who pointed that issue out to them?).

    The 100K settlement from 1992 didn't do the trick with these guys.

    I think I will have some fun with this one. No negotiating.

    Jlynn, lets pioneer this subsequent CA transfer phenomena. Did you send the subsequent CA to CA #2?

    Actually this time, I didn't send the whole letter. Why? I need the cash :)


    I did mention it in the letter in one paragraph "please advise the original creditor that the collection of this account has already been frozen by a request for validation addressed to Stupid CA 1 via a letter dated 11/12/2002".

    I know that as of November of last year Nationwide wasn't bonded in Texas, so I thought I would play this particular CA like a fiddle to see what they would do.

    Obviously it worked :)

    Update- Their legal manager just called me.

    "We had a computer glitch, it should have been marked in dispute per the FCRA"

    My dispute is not with the FCRA. My dispute is you violated the FDCPA - continued collection activity.

    "We haven't called, or sent more letters - we have ceased collection"

    Not according to John LeFevre of the FTC.

    "Are you aware that this is being deleted from your cr?"

    When?

    "It takes about 30 days to cycle"

    Not acceptable. You can send a UDF and have it off within a day or two.

    "What's a UDF? "

    She is going to find out if "they can send a UDF" and will get back with me tomorrow or Friday.

    This is so much fun...

    Nationwide was.. ahem.. good to me recently.... can't speak anymore about it. Let's just say I got me some lunch. I suggest you speak to their compliance department. What office is the account with. They will fold quite easily when things get the least bit nasty for them, I have a nice piece of paper with numbers on it to prove it.

    Don't you know the rule???? You have to come brag before you lay eyes on the settlement agreement that has a confidentiality clause :)
