Thread: If OC Sues Can CA Still Report?!

Question:

If a CA was hired by a prior landlord to collect on a debt and the landlord later sued and won a judgment (appeal in process), is this CA still able to report the debt to the CRA? Or should it instead be listed by the original creditor as a Judgment in the Public Records section of my CR (don't want this, but just trying to clarify).

If the CA couldn't sue you in your state, they may have needed to have the OC sue you, they may or may not still be in the picture.

Has the CA updated the trade line recently, or has it just been sitting there?

Sorry for the late response; I've been away from my computer for a while (tech problems).

To answer your question, I sued the CA for FDCPA/FCRA violations and they turned the matter over to an attorney. That same attorney represented my landlord and my landlord sued me. I lost my case against the CA, but the attorney won the case w/ my landlord. I'm in the process of appeal (Judge was a REAL A-hole), but am just wondering if the CA is still able to report. They have not updated anything (the amount they are reporting is over 1K more than the judgement amount.

ps. Both the CA and my landlord are in my state (Maryland). Also, how do I find out if they are still hired by my landlord (the debt was not sold)?

I am in a similar situation. Landlord has suffered 48k in damages for fire, and and are planning to refer this case to a CA.

Did you represent yourself in courts? I am also hoping that the CA will violate some FDCPA/FCRA
The LL has not gotten a judgment yet and is still sending this off to a CA.

What kind of letter did you get from a CA, and did they place this acct immediately on your report?
Did you ask them for PROOF of debt?

was this debt related to an U.D ( Eviction)
and you owed your landlord $ beyond the sec dep?

so they sent the acct to a CA, you are within the SOL

you then filed suit against the CA for violations and lost because ???

and now the OC filed suit to get a judgment against you for thsi amount if this is the case did you go to court?

like JAm said the OC probably filed suit instead of the CA attorney because of jurisdiction limits.

so in your appeal what are yoru basis and what are you trying to accomplish?
