Judgement Question

As I've said earlier I'm really behind on credit card payment and am waiting to be sued. If you have a judgement against you, what are the chances that a collection agency will take your car if you still owe money on it? In my state, they cannot garnish wages, but they can have a Sheriff's sale and sell your property. How often has anyone heard of that happening?

They can't take your car for a credit card debt.

It wouldn't be for a credit card debt--it would be for a judgment. Once it's a judgment it doesn't matter what the underlying debt is for.

If they get a judgment, it would depend on what the state laws say a creditor can do to satisfy a judgment. It varies from state to state.

Hi hedwig I have a serious question, (not that none of my other question wasn't serious...lol). But I had a judgement placed on my CR and a paid collection for the same debt. But the tricky part comes when I call the court house to get physical evidence that the judgement was filed then they tell me that it was dismissed. I have already paid for the collection and its showing paid on my cr but it hadn't been removed( i know stupid). What steps should I take to remedy this particular problem.

I don't know a lot about the legal process, but I would get a copy of the dismissal and send it to the CRAs.

On the other hand, maybe I'd do a procedures request first. Then when they tell you who they verified with, go back and tell them that you have the copy of the dismissal.

And, you'll find you get your questions answered more quickly by starting new threads instead of tagging on to another thread that isn't exactly the same.
