Just got new bill on chargeoff

    I had an AMEX Charge card charge off in 11/98 with about $14k. I paid it off over time and made final payment in June 2000. No settlement, paid full balance. A week ago, I received a bill for $600. Someone stole my brother's card, which was an AU on my account, but I had cancelled his card back in early '98 because he never paid me back. Anyway, someone stole the card and charged some stuff from the internet and a dinner in Panama City, FL. I have disputed with CRAs and AMEX directly to no avail. Is this the break I need to get it off? Please advise.

    I'm not sure if I undertsand what you mean. Was the account closed when the charge was made? Did you get a bill within 30 days of making a charge (or having that fraud charge made)? Law is they have to send you a statment. If you never got a statement then you can turn back the clock on the 90 days to dispute a charge that you did not make. Yes there might be a few things you can try but first give us more info here?

    The account has been closed for over two years. American Express cancelled the account and charged it off in 11/98. I paid it fully in June 2000. Then all of a sudden I get a bill 2 1/2 years after it was charged off. I am trying to get the original charge off removed because how can an account be charged off if they are still accepting charges on it. If you get my drift....

    Have you called and spoke with them? What was their response to this B.S.? Is this bill just an error or have they kept trying to collect on it (more than one letter)? If you just got one bill and never heard from them again then I would modify the validation letter and write them to request the original contract info and all details of the account because you feel that the account they have linked to your CRA files is not accurate. They will not have your original application on file anymore. Now if they are trying to collect on the $600.00, then just send them a standard validation letter.
