I will be more than likely filing suit against Equifax because they verified my negatives in July, and now they (local affiliate) outright refuses to reinvestigate despite the fact that I sent them copies of the val/estoppel letters sent to the CAâ??s. They refuse to investigate because they were â??previously verified.â? Now I will be sending them a procedural request which I suspect they will ignore because it stated in their letter, quite clearly, that would ignore all my future letters concerning this matter. Now I would have them on several FCRA violations. Anyway, I will be sending them a Notice of intent to sue very soon, Now my question is: 1. Do I continue correspondance with local affiliate or Equifax in Atlanta? Or both? 2. Do I sue both or just local affiliate or just Equifax Atlanta?
I'm in the same boat. I hope to sue the main affiliate because I feel I would have better luck. If I sue the local affiliate they are in my hometown and I know would NOT settle out..but go to court. I hope someone answers you.
Thanks to Lizardking and Christi! I am actually at step 2. When I sent the supporting evidence in the form of val/estoppel and I stated in my letter that they had not responded; they sent me the letter of refusal within their 5 bus day limit as per FCRA. I sent another dispute after that one with complete evidence as well and they ignored it, as they siad they would. I will therefore proceed with the lawsuit after the 30 days are up aginst the local affiliate. What do you think about my demand to give me their investigative procedure?? I know it has been awhile, but their are no constraints in FCRA and I have add'l evidence: a bbb letter from a CA stating that they had no info on me!! And yet the CRA verified!
