Does anyone have info on Mann & Bracken? I found them and they appear to be some kind of law firm/CA out of Atlanta. I received a call from them on voice mail talking about they would be getting an arbitration award and then a judgement or something if I did not call them back. So what I need to know is how to best approach these guys. I called them and they told me who the OC was which I don't know if it was mine or the ex'DW. At any rate it is still within SOL because they did say that it was c/o 6/03. So I told them to write it up and send it to me for review. They said they would and haven't. This was on 2/13/04. Should I take the first step and DV them or just sit tight until I get somthing in writing? And weren't they supposed to write me in 5 days after the initial phone contact? So many quesitons, so little time..........
I've had two accounts go to them. I only received letters, so I never actually talked to them. Sent them validation, no response. Not sure if that helps or not.
Have either of you had any other contact with them since this was first posted last month? I just got my first call from them last night and am wondering how they are to deal with? Specifically, are they really acting as a law firm, or just as a CA? If I ask for validation, will they sue me, or will they ignore my request? And, how much are they asking from you?
In looking at my current spreadsheet, it appears I only have one account with them now. It's for about $6,000. I sent validation, and have heard nothing. The only creditors I hear anything from is Arrow - DV'd them and haven't heard anything else, and Amex (CAs couldn't collect, so now they're harassing me). Amex is being sneaky, but I'm fighting back. They took $$ from my checking account (before finding this board I gave them my account number so they could make a $100 payment) without my knowledge or authorization. I'd suggest anyone that has given their bank info out, change banks! At the least, close that account and open a new one. The $100 payment was several months ago - they took the payment, but "lost" it and wouldnt' update my balance for a few months until the "found" it. So, I'm working to get the $$ that they took back from me, then I'll close the account. Already have all my direct deposit, etc. going to a brand new account at a brand new (non-local) bank. They'll never find it! If the bank can't get it back (not sure why they wouldn't be able to since Amex would have to prove that I authorized the transaction), I'll be suing both the bank and Amex. Amex for an unauthorized transaction, and the bank for not stopping said transaction, and/or when a fraudulent transaction was brought to their attention, they didn't recover my funds. dabster
Can anyone tell me who they represent? I still have some accounts out there and want to know if I can expect a call from them or not. pdecur
They represent Bankone for sure. I got my first call Monday night and got my letter from them yesterday. The letter was from one of the firms attorneys but the call was from a collector. They are licensed to practice law in Georgia and one or two other states. They said they are not licensed to practice law in my state. They also said that I signed an agreement to do arbitration, so they would ask for arbitration and not sue. I do not know what to expect from these people. Anyone have any idea what they will settle for? What kind of payments they will accept? And, most importantly, how long can I put them off before they really do go after me (lawsuit or arbitration)?
I got a Fedex letter from them stating they are going to arbitration (National Arbitration Forum) to settle the account but would still settle before the time limit. It's my understanding that they are a collection agency/law firm representing Chase Manahattan/Bank One in my case. I called them to see what was up (I know, I know). Anyways, I got a guy who was fairly nice and I told him I wanted to settle this account with the removal of the negative tradelines. They went from original 70% settlement, to 62%, and finally agreed to 55% settlement with the removal of the negative tradelines. The original debt was $8,700. They 'should' be faxing over the settlement letter today with the deletion information. We'll see. -Pete
