Marlin Intergrated Capita--it's war

    Found 7 line items with the name "Marlin Intergrated Capital" on my credit report today, all collection accounts, all over 120 days and varying balances between $45 and $49. Searched these posts and learned a lot of their different names and their industry focus. I don't have any unpaid medical bills and I have never received mail from them. Judging from the experiences I have read in these posts, I can tell I am in for a tough battle! All those of you who sued, let me know your outcomes if you can. A simple validation may be all I need to do but I see that getting the right address is an uphill. If you have a definite address/number, please let me know.

    The first thing you do is call the CRA and ask what address and/or phone is listed on the collection account. I believe that by law they have to have and provide this information. Then come back here and we can all help you nail em. The beauty of small collections is that one violation = big profits for you.

    I just sued Marlin Integrated Capital last month. It was the same Glen Falls NY address given to me by the CRA. Guess what I found out???


    They are really NCO Financial Solutions, and this is who I sued and settled out of court with.

    They own Marlin.

    You do not need to put it to the attention of anyone. This is the only name I used when the court mailed the summons to them.

    Their attorney who is a very nice person contacted me the day they received it.

    I couldn't be any happier with them as they complied with all that I asked.

    You already have them on 7 violations (Up to $7,000) so don't worry too much. lol

    One of Marlin's "affliates" is Medclr. Also, AKA NCO Financial.

    2 issues here. One, The CRA's have Medclrs address as the same as NCO's in PA. According to the person I spoke with at the Corporations office in the Department of State for the State of PA, they MUST have a license to do business in PA (using a PA address). They do not. I sent this info to Equifax's Robin Holland who forwarded on to the compliane dept. Deletion was the result! :)

    Two, it is against Federal for ANY collection agency to use ANY name but their own! They claim that they do not own Marlin or any of the others, but are working with them. Yeah, whatever.

    Go get em!

    I reported this to the FTC, BBB of FL, AG of FL. The more complaints they get the merrier.

    I gave them something to consider.... Why would the owner of Marlin and all the affiliates (same guy) have NCO do all the work for him? He purchases defaulted debts. With who's money? The mafia's? Ok, for some of you this may sound ridiculous. But face it, Marlin is out of Key West, the drug import capital of the world. Buying bad debt would be a great way to launder that money! Food for thought!

    Would you please have anything in writing which states collection agencies in Pa need to be licensed??

    I have contacted the department of state and a number of them said "No" and a few said they do not know??

    I contacted the AG's office where the put me on hold forever and then tell me they will call me back but never do. It seems they don't know either!

    I have a pending court date next week against a CA here in Pa and would love to have this info and do some checking.

    Please help me if you can on this!

    I called Equifax number 800-685-1111 but no live person is available. Do you know a number I can use that gets thru to a live person? They don't even show an account number on the CR for God's sake!

    Actually Love provided this number for NCO Credit Bureau Dispute Resolution Unit: 800-221-0158. (Alternative number is 800-207-3081 for immediate assistance). The voice recording (800-207-3081) before you get transferred to a love person insists that you need to send your dispute in writing and no faxes are accepted. I held on and spoke with a woman. I told her it's extremely urgent as I was about to close on a house and that I needed to take care of it right away. Unfortuntely she said I had to have at least an account number but the Equifax CR did not show it. I am in the process of looking for a phone number at Equifax that allows me to speak with a live person so I can get this info.

    I will however try the contact info you gave me above in case I have better luck that route. Thanks.

    Remembered that CSC serves my region. Got the 7 different account numbers from CSC's 800 number and called Marlin back. Marlin said it was checks made to Pizza hut. Definitley ID theft.

    Guess I'll send validation now.

    Ok, please do not misinterpret what I am saying here. CAs don't have to be licensed as your questions indicates. BUSINESSES must be registered to DO BUSINESS in PA. That means they claim a PA address. If they are in FL, don't need it. BUT with ALL of Marlin affiliates, when you ask where to send service of suit, payments, the addy that the CRAs have, it is ALL NCOs PA address.

    There is, then, the implication that Marlin is doing business in PA without having legally registered to do so.

    Sorry for the confusion. Easy to mix license with registration (I was inaccurately mixing the 2).

    I am in the same situation, but with a twist. I have an NCO account on my CR and a Marlin Integ. acct listed. Both accts are collecting on the same money. My thing is, I would like to sue them, but I think I have blown my chances b/c before I found out about their violations, I contacted Marlin to set up a payment plan. Since doing that, I have only sent in one payment of $50. Have I admitted to this debt? How can I proceed from this point? Go ahead and pay them off and ask for a PIF and/or DELETION? Or try and sue them? If suing is still an option, how do I proceed in filing a suit? Where do I start as far as paperwork?

    Help.

    Generally, foreign corporations may not do business in Pennsylvania without receiving a Certificate of Authority from the Secretary of the Commonwealth. To receive a Certificate of Authority, a foreign corporation must file form DSCB:15-4124/6124* accompanied by a docketing statement*, the Certificate of Authority must contain the following information:

    Remember the basis of this arguement is that they USE and PA ADDRESS.

    It depends on what you said during your conversation with the CA. Paying a debt does not in itself admit liability. For example, CA on bureau for $41. Offer PIF and deletion is cheaper that fighting them.

    Next, you can confront the NCO affiliate that there are legal issues with their right to collect on this debt and to start the validation process.

    This issue of the legal right to do business in PA only applies to Marlin companies. NCO IS a valid corporation and can legally collect under their own name.

    Your dispute does NOT have to be in writing, tho it is best.

    This may be a violation.
