Midland Funding has been contacting me now for about 6 months to pay an outstanding debt. They call about once a month. The past 3 months I have asked them to VALIDATE that this debt or remove it from my credit report. Today the lady told me that they sent me the validation in 2012 and they only send that out 1 time (I guess that is when they bought the debt). She can send me a CONFIRMATION (which is just a paper that says pay them). I told her I never received the validation but she informed me they would not send that again.. even though I have never received. Next steps? Validation is specific evidence, that (a) the debt is yours, and (b) that the amount of the debt is 100% complete, accurate, and doesn't contain any fees not allowed by the contract or state law. Now, since they need to obtain the validation from the original creditor, and there may be a cost associated with that, I can see why they would say that they only want to obtain validation once. Here's the rub, if they actually provided it, why didn't they make a copy of it? Are you talking to them on the phone? (Rule #1: DON'T) Send them a letter via CMRRR or Fax, demanding validation.
