Military activations and Charge offs

    Hi there.....

    This is my first posting. Bare with me.

    I had a GMAC account for a lease, started in 2001. I was activated in 2002 for military duty. I had my dad turn in my lease for me. They (GMAC) wanted military orders to verify that I was turning in my lease. I faxe them and they accepted the car.

    Now I have a charge off with GMAC.

    The current status on my report is: PAYS AS AGREED

    Date opened: 12/2001

    Date if last payment: 01/2003

    Date reported: 06/2004

    Date of last activity: 01/2003

    Activity description: paid and closed

    Charge off amount $0

    Date closed 01/2003

    Comments; none

    break....

    On my report from Equifax it is listed as a CO (charge off) in Aug 2002. How can that be when my orders didn't start until Oct 2002?

    I have done the online dispute form from Equifax. The other credit reports do not show a charge off.

    I NEVER had late payments or anything! I currently have a GMAC car lease now!

    Does the Soldier and sailor civili relief act (SCRA) cover me here?

    The new SCRA says people can get out of leases with no problems but mine was before the new SCRA.

    HELP...

    As far as your question "does the soldier and sailor civil relief act cover you" - I doubt it. You are dealing with a creditor who doesn't give a flying f..k about anyone, civilian and/or military. Creditors are heartless scum.

    It doesn't matter how heartless you think creditors are, there are laws that they must follow. If they choose not to, they will be subject to any penalties imposed by the law.

    FormerMP, I believe that the SCRA may still cover you. There have always been some protections there.

    The best way to find out is to contact your JAG officer. They are the most familiar with the SCRA, obviously. They can tell you what your rights and protections are, and help you with any next steps.

    The worst that happens is they say you're not protected. In that case, you may also be able to write a letter to the executives at GMAC and make your case.

    But go to JAG first.

    Absolute garbage. We have a contact in GMAC that may be able to assist you. They're not heartless by the way, at least as far as creditors go.

    GMAC says that the car was returned under the SCRA...Equifax says it is listed as a chargeoff...the girl int he credit department even mentioned the SCRA...I didn't even have to mention the SCRA to her...she say why it (the car lease) was taken back, which means on the surface the charge off should of never happened...we shall see.

    Here is my hope....

    once the investigation is complete...

    GMAC has told Equifax that the charge-off should of never happened and Equifax removed it.

    I hope that level minded people will prevail..this one is too simple.

    I mean is it tht easy?

    Can I request something from GMAC to prove that they took it in and a charge off should of never had occured ?....and they do not list it as a CO?

    Will Eqifax listen at all?

    GMAC can be easy to work with if you get up the food chain . . . EQ must do what the furnisher states.

    Agreed...I would work with GMAC if you can.
