My letter....QUIXOTE!!!!

    Please critique!


    Mr. Cooke,

    I appreciate your efforts in trying to have my old account with you reported to the credit bureaus correctly, however it seems to me it may be impossible.

    This effort has been on-going since November of 2001, as I am sure you recall. I have many credit reports over the last 12 months showing this account being reported MANY different ways.

    As I have told you in phone conversations and emails, I am in the process of buying a home. With this tradeline constantly changing it is making it difficult for me to get the financing terms I deserve. If I were to lock into a higher rate, it could possibly cost me thousands of dollars in unnecessary interest..

    It has been 9 months of us attempting to fix this problem, and once I think itâ??s fixed, something happens and itâ??s back to the way it was, or worse.

    Mr. Cooke I have to ask you, what makes you think this time will be the final time this account needs to be fixed? Iâ??m sure you thought the first time would end this all, as well did I, but it didnâ??t. Honestly I donâ??t think this will end.

    Capital One has put my back against the wall, but being a reasonable person, I am willing to give you one last opportunity. I believe you would agree with me, that it would be easier to have this account removed from my credit reports, than to battle this for the next 2-3 years.

    I, in no means intend this to be threatening, but if I can not be assured that this matter is put to rest, permanently, than Capital One will leave me with no choice but to utilize the FCRA to my benefit. Iâ??m sure you are well aware of Nelson vs. Chase Manhattan. Although I would prefer not to go this route, I am sure you understand it is my duty to protect my family.

    I hate to put demands on people, especially people that, in the past, have been so willing to help me, but this has gone past affecting only me.

    Please contact me by Thursday August 8th at the latest to let me know if I should file a lawsuit against Capital One. Mr. Cooke, the ball is in your court, only you can end this all for good.

    I'm not Quixote, but I think that you wrote an awesome letter. You showed that you have been very, very patient. Charlie

    I am not QUIXOTE as well but I have to say that it is a great letter. It clearly shows that you have been very patient.

    Do you think I am stepping on toes? Mr Cooke agreed to change my R9 to an R5 back in November and it's been back and forth since.

    Although before all of this it has changed many different times from PIF charged off to settled for less than balance charge off. The reporting dates are all different i.e. open date, close date, DOLA etc.

    One report says: opened 4/98 charged off 1/98.

    It's easy for me to remember the date cause I got it in 4/98 and NEVER made a payment on it.

    Still think I'm being patient, or maybe too demanding (that's what I feel)
