    A Collectorâ??s Wish List

    Dear Santa,
We realize that you are very busy this time of the year. But please Santa, when you have a few moments, please see if you can help us out.

    1. Please Santa, allow us to tell debtors how we really feel without breaking any FDCPA rules.
    2. We wish all debtors would pay balances in full.
    3. We wish all information received from clients on new claims would be correct and current.
    4. We wish all debtors be required to furnish character references.
    5. It would be really great if could receive documentation a little faster.
    6. It would also be great if applications and statements were available on all files so we could really stick it to those scandalous debtors that count on clients not being able to get documents so that they wonâ??t have to pay.
    7. Oh Santa!! What we wouldnâ??t give for a social security number with each file.
    8. We wish collectors could speak to debtors the way they are spoken to. Only one day Santa, and we would work from 8:00AM to 9:00 PM.
    9. We wish for clients that would return our phone calls.
    10. We wish for season tickets from the CUBS--?? ( I guess we each have different priorities.)

    Thank you Santa
Happy Holidayâ??s from the Kohn Law Firm Collection Staff

    UGHHH!!!!!

And in response to her - -

    Dear Santa,

I have a plan, if you would allow all debtors to win the lottery (no CAs allowed), then you could easily fulfil the previous wish list!

    Thanks!

    Santa's Reply:

Dear Staff of Kohn Law Firm:

I have a couple of requests from the people you dun for payment, and I figured I'd pass them along.

    1. They inform the that while you consider your account important, they have some things going on that are equally if not more important. Those things include such luxuries as food, clothing and shelter. They would like you to consider that these things come FIRST in their lives.

    2. Maybe you should realize that being told once a day "I don't have the money" will not change the fifth time you call in that same day. Calling debtors on the telephone and being rude, nasty and condescending does NOT create money to pay you with.

    3. When a debtor invokes their rights under FDCPA, it is NOT a suggestion, it is their right. Respect it or you only get coal this Christmas.

    4. The debtor not having money on Monday does not necessarily mean you have to call six times on Tuesday to see if they won the Lottery that night, and to ask them why they didn't, and to berate them for wasting YOUR money on LOSING lottery tickets. (winning lottery tickets are okay to buy)

    5. A little honesty and character goes a long way. When you make an agreement, offer to put it in writing for the protection of all (and call the ambulance to the debtor's house when you do, since he probably had a heart attack out of shock).

    5. In light on #5 above, after you make an agreement, stick to your end.

    6. Learn a little leniency. Sure you have a debt to collect, but maybe, just maybe, you are not the only creditor. Work with the debtor to formulate a plan that satisfies everyone and treats all creditors fairly. After all, when you are getting YOUR payment because you made the nastiest threat, all other creditors are lining up to get theirs. Few bankruptcies are premeditated - most are filed because the debtor got no relief from creditors except through the bankruptcy court.

You really have been a bunch of bad kiddies for a long time. No presents for you this year.

    Santa
