Need validation advice....

    What would you do in this situation?

    There is a $600 debt on a $300 card that charged off in 1999. Orchard Visa to be precise. It is dad's. Disputed it right off EX and EQ. Not off TU.

    However, a collector has been calling about this account for a few months (before these disputes).

    Should he (or I as his rep):

    A) keep disputing on TU and hope that Orchard and this LDG Financial goes away.

    B) send Orchard a validation and risk having it put back on EQ and EX.

    C) send LDG a validation letter.

    D) send Orchard an offer to settle.

    E) send LDG an offer to settle.

    I'm suspicious that it flew right off EQ and EX because it recently was turned over to collections.

    Help? :)

    Send LDG a validation. If by chance they can properly validate, then you can send an offer of settlement to Orchard. However, if you want to pay the acct., then send an offer of settlement.

    I would bet though that the ca cannot validate it. If after 30 days you don't get a response, send the estoppel. 30 days after that you can send a letter to TU demanding removal of the acct. based upon their failure to validate.

    I can't guarantee they will remove it, but I just did this with gulf state. I sent the cra a letter for removal along with copies of the letters and certified receipts I sent gulf schmucks, I mean gulf states. They didn't immediately remove it as I asked for. They started another investigation which is up on 1/11 - this coming Friday, and so far gulf states hasn't responded.

    I will update the board on this next Friday.
