Opt Out and Equifax

I called the 800 opt out number in the middle of December and opted out for two years. My Equifax report has clearly stated since late December "Promotional Block - File blocked for Promotional Purposes." I received an updated report last week and on it there is a PRM inquiry from Name Seekers (this is an auto loan finance company) that was pulled on 1/11/02.

Has anyone else had this happen? Can Equifax be sued for this? This, I think would be an FTC violation and not FCRA, right? Supposedly PRM's are not supposed to affect your score, but who knows. Besides, what is the purpose of opting out and a promo block if these inquiries are still happening?

I guess I am the only one that has had a promo pulled after a Promo block to my credit report.

Actually, I got a CapOne preapproval this week and I opted out over a month ago. I know I've seen the notation on my EQ report, but do EX and TU note it similarly? I thought it was a little strange, since I do not have and have never had an account with CapOne.

To my knowledge, TU and EX do not have the notation. Then again, on my recent reports, I do not have any promotional inquiries either. So I would think TU and EX are complying.

What is the point of opting out if these inquiries are still being pulled. I would think there would be some sort of violation here. It's nice not getting that junk mail from cards that I would not be approved for anyway, but I would like to keep my report as clean from these inquiries as possible.

It's the principle and I might just pursue this with EQ.

I know. All my good promo offers came from EXP, then, when I accepted, they checked EFX or TU. The tax liens are on EFX and TU, so that score isn't as high (the real one, I'm sure), and I would get turned down. Every promo offer from EFX and TU was subprime. I do better on my own :)

It's not supposed to, but who knows. I think Marie is trying a theory on this topic.

After being opt out for almost a year, I noticed 2 PRM inq on my TU. Isn't that against the law?

Does that in any way violates FCRA?
