Please help! Capital One!

    I have a charge-off with Capital One from 08/98 (I'm sure some of you know this) which at the time was $550, but has now grown to $2500. I sent Capital One a debt validation letter on March 15th, in fact, I used the sample one off of this site and included a Creditor Disclosure statement for them to fill out and return to me. I got a reply from them today and all they sent me was the original account agreement that I signed. No creditor disclosure statement, no proof of the debt, nothing. So now what do I do? Send them a second validation letter? Demand that my debt be erased and the item deleted from my credit reports since they didn't comply with what I asked of them, i.e. the disclosure statement? What are my options and/or what should I do next? Thanks so much!

    isnt this item going to fall off your reports soon?

    whats the SOL for this account type and your state?

    Did Cap 1 ever send this to a CA?

    have you disputed this tradeline with the CRA's?

    If I'm not mistaken, Capital One doesn't have to validate, since they are the original creditor.

    it would be called verification of an alledged debt or acct. not verification

    It falls off my report next summer, since I live in Ohio and the SOL is the standard 7 years. Capital One did send this to a collection agency back in 1999, but when I questioned its validity, I never heard from the agency again and it never appeared on my credit report. I have disputed this tradeline with all three bureaus, but it always comes back verified. Funny, since when I ask the same information directly from Capital One, i.e. the validation I just sent out last month, I get nothing from them. So what are the CRAs getting then?

    Should I write them and say that because they are apparently not able to furnish me with what I asked for, validation of my supposed debt, then they must waive all claims of it against me? Suggestions?

    cap 1 rearly replies go to my posting help 4 all consumers I posted the e-mail and snail mail address there for their regulatory compliance division.

    ask for verification for an acct and list the ACCT #
    if you e-mail keep a copy for your records if you snail mail do it CMRRR that way you can prove the 30 days.( for future violations)

    write a letter disputing the account and request that they verify the information being reported to the CRA by providing answers to the following questions.
    and that they flag your CR disputed.

    state you are requesting all information pertaining to the above listed account
    date opened
    current status
    balance due
    interest rate
    verify your name, add, ss# etc.
    reuest copy of signed cc app to prove the terms you agreed upon
    all billing statements reflecting charges & credit for the acct etc.

    then state pursuant to the FCRA I am requesting tha you verify this information within 30 days from the date of this letter .

    if they still ignore you 30 days after recieving your letter send a copy of your letter and a copy of your CMRRR to the CRA and request deletion state that you directly disputed this acct with the OC and you are unable to obtain verification for the acct listed on your CR.

    if this still doesnt work contact the richmond BBB and file a complaint then contact the Federal Reserve and do the same.

    if all else fails get an attorney and file suit.
