Received a Letter PAID IN FULL....

    very, very long story and it may be confusing but here goes...

    Had an account with Dell. They kept messing up the payments. Called 3 times to say that we were late 60 days, then a month later at 90 days. Paid them over the phone and told them we didn't know what was going on. We had the account nearly paid in full and told them we had sent the payment EVERY month. We faxed them statements from our bank and proof that they had cashed the checks.

    Didn't hear from them in about 2 weeks, suddenly we get a refund of $126 and a letter saying that they apologize for the confusion and that our account was paid in full.

    Now the bad part, Collection Agency called today demanding money saying that we were 110 days late. My wife talked to them and faxed them the letter stating that our account was paid in full.

    Do we have a leg to stand on? To be honest, I know the account is NOT completely paid in full. But they posted the negative account to her credit report and now I don't know how to get it removed except to just stick by the letter. She has PERFECT credit even though we were on the verge of filing a BK Ch. 7 a month ago, she has since landed a good job and we are back on our feet again. This is the first negative mark on her report. I'm afraid that if we start paying it again, that they will NEVER do a thing about the negative posting.

    Do we stick to the pay off letter? Or do something else?

    IMO, I would sent them a copy of the pay off letter and a stern warning that if they continue to try and collect, that they will see you in court.If you ignore it, it will not go away.

    Paid in full means paid in full.

    While you're writing the sternly worded letter, don't forget the part about willful " innacurate reporting" being a $1000 violaton.

    Dude! you're getting a check! :)

    Actually, If you need Xmas money, send them a Validation letter. Let them prove you are 110 days late etc. Then if they continue collections, Take their butts to court. I am vindictive, that's how I would do it.
