Regarding recent dispute w/ EQ & EX

    All,

    I have a question about a recent disputed item I got a response to via EQ and EX. Details of the account XXXX are below. (Questions are below the Account information below)

    Is this still extremely negative, somewhat positive or in limbo? When I look at the FICO score, it states as positive and says the following:

    1) There is no evidence of you having seriously late payment behavior being reported on your credit accounts
    2) The time since your most recent past due payment is old or unknown
    3) Two dates with 30+ lates are unknown. Isn't it illegal to post if it is unknown?

    Is this account bad but giving positive results on the FICO score?? I just don't get it.

    Any help would be appreciated.

    PAST DUE DATES MUST BE KNOWN!!!

    If they are "UNKNOWN" they MUST be removed.

    FOR ALL I KNOW, YOU COULD HAVE BEEN IN ELEMENTARY SCHOOL WHEN YOU WERE LATE...since they are "unknown" dates...

    The "UNKNOWN DATE" could be----->12/2002 (hasn't happend yet)!!!

    On my EQ for 2 accounts, all my lates are unknown. The rep claimed that if the OC reported it that way, it was totally legal for them to report it on my file. I told her that is BS and how am I supposed to know when the 7 years is up. I mean obviously is common sense and yea, they lack that, but at that point when she wouldn't give in, I didn't know what to say so I will just add it to my list of violations and issues that I will be sending to Glenn King shortly. Any suggestions on what I should say regarding the unknown dates?

    "I stopped using the card for one year because I was ticked at them...SINCE THEY ARE UNKNOWN DATES...it could have been in that year WHEN I OWED NOTHING AND CHARGED NOTHING"

    "How do I know if I was of "LEGAL" age when the dates happened"

    "How do I know if I was even born"

    "FOR ALL I KNOW...it may be a LATE from 01/65"

    To the best of my knowledge the is NO Glenn King. A made up name. Like Larson from Citibank. Just a name the company uses. Some older posts address this as well.

    I am a newbie here, feeling shy, and I hesitate to speak up in front of so many well informed and knowledgeable "old timers," but here goes:

    FCRA Section 611(a)(5)(A) In general. If, after any reinvestigation under paragraph (1) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or cannot be verified, the consumer reporting agency shall promptly delete that item of information from the consumer's file or modify that item of information, as appropriate, based on the results of the reinvestigation.

    If they aren't showing the dates of the lates, then the item of information is incomplete and should be promptly deleted (yeah, right), but at least that gives you a basis for an argument.

    Hey herauntsis- good to see you here :) I think the problem with your reasoning is that it's just that- reason. They won't understand it as they lack the capacy to "reason".
    This is connected to my other post that you replied to elsewhere about the procedural description and not getting any answers from EQ. I'm totally on their ignore :(

    Hey, Swede, good to see you too ;) I was feeling a little intimidated by this board, and it's nice to see a familiar face.

    Yeah, I know what you mean about the CRAs not responding to reason. I am particularly hot on this subject of dates right now. I work for a mortgage broker, and one of our clients has a foreclosure that she redeemed. All that is keeping her from getting a decent loan is that we can't get TU to add the date of the redemption. We have sent a copy of the recorded document to them twice, but they say there is no place on the computer to add the date. Grrrrrrrrr! I am going to try one more time (the last time I tried, I hadn't found this section of the FCRA yet) to get them to either add the date, or remove any mention of the foreclosure (which is what the other CRAs did), and if I don't have any luck, then I am going to tell her to file suit. She should be able to prove damages, because she has already been turned down for a loan based on the fact that no date is on the report.

    Just as an aside about how scores sometimes don't make any sense -- this woman and her husband have scores in the high 600s and low 700s, yet they have had three redeemed foreclosures, and over 50 mortgage lates. Their scores are higher than mine, and my credit isn't actually that bad. How the hell does that work?

    I was a little afraid too at first but people are very friendly/helpful. Donâ??t be scared :)
    Itâ??s really not our fault that TUâ??s software has not caught up this century, if they have place to add lates, they'll have place to delete it too. Did the other CRAâ??s remove only the lates or the entire account? When they removed, did they do it out of the goodness of their hearts â??yea right- or did you quote that section of FCRA?

    I am not at work now, so I can't remember which did what. One deleted the trade lines entirely, and the other one just dropped the mention of the foreclosures. I didn't quote the FCRA at them or anything, just disputed and asked them to add the date the foreclosures were redeemed.
