Registered Agents Question, Help!

    Hi guys,

    I understand that if a company has a registered agent then that is the person who must be served with the court papers for that company.

    Is the Registered agent also listed under "Defendant"??

    I am about to sue Kohl's department store for an non-permissible inquiry on my credit report. Do I have to list under defendant just...."Kohl's Department Store's Inc." or do I have to list the CEO or registered serving agent's name in there as well.

    I have filed suits against collection agencies but none of those had a serving agent. They were sent via certified mail restricted delivery. The court clerk for those said I didn't have to list a name other then the name of the company I was suing and anyone could sign at that address.

    I just want to make sure my bases are covered so I don't have any delays.

    Hi,

    You name the corporation as the defendant. The registered agent is not a defendant but merely serves as the person (or entity) that is physically served with the summons and complaint.

    Were any of those collection agencies out of your home state?

    Both of them were in my home state of PA, only 1 showed up the other I won be default. I have yet to sue anyone outside of the state.

    Another question I have....Do you list the corporations name but the registered agent's adress??

    I would think that is the case but I thought I'd ask.

    You list the corp name c/o authorized agent or corp. name bsu (by service upon) authorized agent.
