Restrictive endorsements-A CROCK!

I emailed Kristy Welch @ creditinfocenter.com and asked her this:

I was on your site:
http://www.carreonandassociates.com/4settle.htm and would like to know if the states listed on this webpage is where the creditor must be located or where the debtors must reside in order for the case law to be applicable.

She replied:

Actually, they get to pick which state they want, yours or the state they do business in. Obviously, they will pick the state with the longest SOL.

THIS REALLY STINKS!!!!!!!!!!!!!!!!!!!

I used restrictive endorsement on a payment and the lawyer didn't write anything on the check(I'm in New York) so he lost the option to sue me.He was so pissed,but he knows I'm right.He is a lawyer and should have know better.hehe

F.Y.I. some credit card companies have added "FINE PRINT" that basically says~~~"WE DON'T TAKE CHECKS WITH RESTRICTIVE ENDORCEMENTS...IF WE DO CASH IT BY MISTAKE, WE ARE NOT BOUND BY ANY OF THE RESTRICTIONS...IF WE SEND THE CHECK BACK UNCASHED BECAUSE IT HAS A RESTRICTIVE ENDORCEMENT, WE HAVE A RIGHT TO CALL IT A 'BOUNCED' CHECK AND YOU ARE SUBJECT TO ANY FEES AND/OR PENALITY INTEREST RATES"
