Right amount wrong credit card

    I just rec'vd new credit reports from Trans Union & experian and I noticed something odd.

    All I have negative is one card that I agreed to pay $50 monthly in 2012. I went to court but negotiated the $50 mo on the card with a $10k balance so there was no judgement. But when I checked the reports I realized I was paying for another card that was taken off by Trans/Experion several years ago and had $3599 on it.

    Basically I'm paying for the $10k Visa with payments going to a different $3599 Visa card?

    Can this be correct?

    Did you have two cards with the same issuer? You don't pay TU or EX, you pay the creditor directly, and whatever this agreement is that you have (in writing, presumably) would have the account in question you're paying $50 a month towards. If the account listed on your reports has a different account number, then you should probably contact the creditor to determine what is going on.

    Not paying TU or EX, just downloaded new credit listings. I only have one card with Portfolio for a cc debt of $10k originally but I brought it down to $7k at $50/mo. However TU and EX are reporting it on another card that's been written off. I will contact creditor but just wanted any comments, advice, etc.

    If the charges are correct, there is a chance that something got crossed in the reporting somewhere. At last you are able to identify the actual charges. Make sure that you have it in writing what they are planning to do about this mistaken ‘card identity’ and go from there. Looking forward to hearing the updates

    I sent three letters, two to CR guys and 1 to Consumer Response. Maybe they won't do anything but it'll be interesting anyways. Will send query to the collection co. in a week, see what their response is. Maybe I'm misinterpreting the CR's but I don't think so. Will get back once I hear.

    OK, since Portfolio isn't a credit card company, could it be that the account the payments are being shown towards is the ORIGINAL CREDITOR and they are updating their reporting based on Portfolio getting the check?

    I pay Portfolio (collection copy) $50/mo for Card A debt and it's showing on Card B which Portfolio is saying they're collecting. Not the same card. I made a settlement for Card A but the money is going to Card B of which I never had any collection settlement, nor any correspondence on it.

    Ok, then, the option would be to send to Portfolio a letter that they are in breech of the settlement agreement, and in violation of the FDCPA for engaging in unconscionable acts in the collection of a debt.

    If it was me, I would file the suit on both accounts, the one that they entered into the payment agreement on ($1,000 damages) and the one that they (a) never sent collection notices on, and (b) applied payment to illegally. ($1,000 damages)

    Sounds good, I've sent letters to credit reports and thought I'd wait a week till I write to Portfolio. Would be nice if what you said could happen. Will give it a try. Can I sue them in small claims or do I need a lawyer?

    I personally use Federal Court without a lawyer.

    Your local federal court probably has templates that can simplify the process.

    Small claims probably wouldn't be the best to interpret federal law.

    Update: I wrote trans union credit report and they wrote me that they deleted it. Equifax sent me 5 pages of nothing and that I should call to find out. Waiting for the other credit report company.

    Just to catch up, all three credit reports deleted Portfolio's claim to the wrong credit card. I guess a minor victory for the little guy. I also sent a letter to Consumer Financial Protection Bureau and am waiting a little longer to see what Portfolio says if anything.

    Should I ask them why they were making payments to the wrong card which now has been deleted? What about my payments that went to the wrong card. Do I have a case?

    Anyways, glad to have the offending card deleted.
