I sent the validation letter to a creditor and they are asking me to assist them in resolving the matter. They are asking me to outline my dispute (which I thought was clear in the initial letter) and/or any proof I may have to support my claim. Isn't the burden of proof on them? I believe I may have them because the name they have listed on the letter is NOT me and also the Original Account they have is Discover and I have never had a Discover Card. Any thoughts?
Tell them under the law if they can not validate they must delete the listing and cease ALL collection activity IMMEDIATELY...and WITHOUT any further assistance from you. -Peace, Dave
Sounds like it really isn't yours. Or they are totally screwed up. Don't send them anything no matter how nicely they ask you to "assist" them. Was your validation letter in response to a collection letter only, or have they put this on your reports?
I've just been through this... "Sir I need your help in resolving this matter." "You had 30 days to get your act together I'm not helping you with anything!" I issued a few more threats and the deletion was faxed to me by 12 noon the next day. Don't help them with anything. Would you pull the trigger for a gunmen who is pointing it at you ? If you indeed LEGALLY owe this debt then they should have proof on file of it. If not... bye bye trade line.
