SOL Question

    This is in relation to the CA thread posted earlier...but also kind of a general question too. Hence the new thread.

    The account in question that the CA recently contacted me does not show up on any of my CRs. There is no TL from the OC on this account on any CR either. But from an earlier CR that I pulled in Feb 2007, there is an entry about that account - a different CA purchasing the account. But this entry does not have any "Last account activity" info or any "Last Payment Received" info. The only thing I could find from the old CR is that my TL will stay on my CR till December 2011(even though it doesn't show up on the CRs anymore). I do not have any documents regarding when I made the last payment to the OC for this account.

    I am from Colorado and I found out that the SOL for Colorado for Credit cards is 3 years.

    1)Can I calculate the SOL for this account by subtracting 4 years from the this date as TLs remain on credit report for 7 years from last activity? If that is the case the SOL expired at the end of 2007. How do I find out for sure?

    2) Another related question is : I have other charged off accounts that show slightly different "Last account activity" date and "Last Payment Received" date. Some of them are months apart. Which one should I use to calculate SOL?

    When did you first go delinquent on the account? That is how the SOL is calculated.

    It could Dec 2004, Jan 2005 or Feb 2005 and not any later than that . I have no record of the last payment.

    Is there any other way of finding out the last payment on the account to calculate SOL ?

    You could try calling the OC and asking them.

    You could also try calling your bank and get your statements and check images for those three months.

    CRs are only useful as guidance if complete information is unavailable; they have no bearing on anything legal as regards the actual account. They are merely a record of what has been reported[/].

    One other point, negative TLs stay on for 7 years from the date of first delinquency (DOFD); convention and practice have established that they can actually stay on the report for up to 7 years plus 180 days.
