Recently had Citibank call the neighbor's house looking for my girlfriend (live in). GF called Citibank to inquire and they indicated she had a balance of $400 from 8 years ago! She believed she had closed the account and paid it off and had not received any calls or mail in the last 8 years. Is there a limitation to how long a creditor can come back to collect? Is it acceptable (per FRCA) to call my neighbor to track down my GF? Until 6 months ago, she had always had phone numbers and addresses in her name. This just seems bizzare. Thanks in advance for any input.
Citibank is the OC, and is not covered under FDCPA, however you might check your state's laws. Since it is 8 years old it is *probably* out of SOL for collections, but you again, you would need to check your state's laws to verify.
I seriously doubt that this is Citibank calling. It has to be a collection agency, using their name. Get a name and address for whoever is calling. It's legal for a CA to call a neighbor to try to locate someone, if they do not disclose the nature of the call. It is not legal for them to say they are Citibank when they are not.
Also, unless you are at a different IP address, the SOL in your state is 4 years. Whoever it is that's calling, first find out who they really are, and get their address, then send them a C&D letter (tell them in writing to get lost, that you know the debt is "out of statute.")
