suing OC

    Before I file suit against a OC for violating the FCRA, do I need to dispute with the CRA first?

    Hi, have u even alerted the OC that the tradeline is an error? They are entitled to make an honest mistake under the FCRA, but they do need to correct it after receiving notice of the dispute. GL

    Welcome to the board guys.


    In short, YES!

    A careful read of the FCRA reveals that before one has a legal claim against a DF for FCRA violations that DF must FIRST be notified of your dispute BY THE CRA, NOT you.

    Absent special circumstances, the only time I would go directly to the DF prior to disputing with the CRA, (or instead of) would be to illicit a no PP pull on a paid account.
