Tears - New Alert

    I just received an alert from Experian with a Major Derogatory? It was actually something I sent a check to today (to the original creditor). I tried to get it before it hit my credit report. Guess I was late. Anyway, it appears on EQU and EXP.

    Equifax report it as a new collection
    Experian reports it as a Major Deragatory

    Why is one different than the other? When I click on view with Equ it list the CA, Amount, Acct#, their contact info.

    When I click view on Equifax is has major differences;

    I tried to call Exp BUT there seems to be no humans around I just GET information on an account I disputed 1 month ago that they deleted. On a good note, I received an e-mail from TU that they deleted another account not verified. So, the ONLY things on my CR that are negative is this new alert and 1 account that I could not get any of the CA or OC to removed.

    Sorry to hear about the new alert, but there are plenty of things you can do. First off, I would deal with the OC.

    One way, especially if the OC cashes the check, is to wait for proof it has been cashed and then send a simple letter to the CA telling them it was paid. Ask them to delete it from your credit report, but don't send them a copy of the check--CA's are widely known to use the account information on the check to deduct monies from your checking account.

    A better route for deletion of the new collection account reported by Credit Protection Associates is to request proper validation from them and the date the account was sent to collection. Moreover, advise them that they have 30 days to respond pursuant to the Texas Financial Code or that they must delete the account tradeline. Typically, they do neither. This isn't a bad thing insofar as you can then acheive removal and/or obtain some marginal compensation via the FDCPA. If you elect to follow the above, I'll be glad to refer you to some excellent Texas consumer attorney's who'd handle the matter.

    Should I still quote Texas law even though I live in NY?

    BellaRuss, I did contact the OC. I called the CA and they were a little snippy so since the account is still very new I called the OC. I'm hoping to get somewhere with them. The bad part of this is that I had already sent the check to pay the account.

    I spoke with TU this morning, they deleted 2 more account off my CR. I'm doing so well with this thing. This new alert is not on TU. So, as far as I know...........I have no more negative information on my TU report.

    No, I am sorry. I misread your post. I thought it said you live in Texas. From what I understand it requires your living in Texas in order to be protected by its laws, although some have used the business' presence in Texas to force the Texas based companies to comply with Texas law.

    You really ought not do this on the telephone. Plenty of Newbies try it, but very few vets recommend it. Try the trusty US Mails, because a paper trail is far more effective down the road than is paperwork.

    Did TU delete the other two TL's, or simply dispute them?

    They deleted them all together. I had a total of 8 disputes going with all 3 CRA's and as of today I only have 2 left that are still under investigation. The rest have been deleted. I actually had 2 (or 3 i can't remember) PFD that were also deleted. When I paid the accounts I disputed them as "incorrect balance". Instead of the CRA's updated it, they delted it. My credit report has been updated with the CRA, I received 1 of them this week, TU is mailing the updated version today and Equifax mailed theirs last week.

    Incorporation in Texas avails them to the laws of that jurisdiction . . .

    Yes, apex, it avails them to the laws of that state, and it also requires them to abide by the laws of that fine state.
